Ex-Marine Daniel Penny insisted to The Post Saturday that the chokehold killing of Jordan Neely had nothing to do with race — and everything to do with a broken system “that so desperately failed us.”
In his first public comments since the caught-on-video May 1 tragedy on an F train, Penny was both soft-spoken and stoic about being at the center of a political and racial firestorm, as he faces criminal charges that could send him to prison for up to 15 years.
“This had nothing to do with race,” said Penny, 24, sitting under a gazebo at Argyle Park in Babylon, not far from the Long Island beaches where he grew up surfing.
Dressed in black slacks, a blue zip-up jacket and beat-up Vans sneakers, Penny didn’t flinch when asked about Neely, a black, 30-year-old mentally ill homeless man.
“I judge a person based on their character. I’m not a white supremacist.
“I mean, it’s, it’s a little bit comical. Everybody who’s ever met me can tell you, I love all people, I love all cultures. You can tell by my past and all my travels and adventures around the world. I was actually planning a road trip through Africa before this happened.”
He is not a vigilante, Penny said. “I’m a normal guy.”
The confrontation on the train began after Neely allegedly began yelling at other straphangers and throwing trash. Penny said he could not go into detail about the events that then transpired because of his pending case, but he indicated it wasn’t like “anything I’d experienced before.”

There will be something that opens the flood gates for millions of Americans to take personal control in a massive, public way to immediately halt this epidemic of injustice and wickedness and deliver a long-overdue reckoning against these scoundrels and kooks in which they will be taught a lesson for the ages.
It’s the theme of “the man who just wants to be left alone” but, when tyrants push him too far, becomes a ruthless punisher like nobody has ever seen and unleashes the fury of hell until the streets run red with blood.
If only said man would also take his wrath out on the plutocrats of Palm Beach County and SW Connecticut who fund a lot of this BS.

I believe this guy. Obviously, he and the other passengers tried to do the right thing by restraining Neely. But, if the chokehold really did cause Neely’s death, then Penny still may end up in prison. I wish Penny hadn’t done anything. Then, he would be on his way to his next adventure, traveling the world.
There are many stories like Penny’s. The other day, another young man named Brandon Cowins was convicted for (he says accidentally) killing a man who’d just shot toward Cowin’s girlfriend and his neighbor. Cowins hopped into his car to chase after the armed man, in an effort (he says) to stop him from shooting at anyone else. But, because he ended up crashing and hitting the man, killing him, he was charged with 1st degree murder. The jury found him guilty of 2nd degree murder, and now he’s facing a sentence of 30 years.
This can happen to any one of us. Even with the best intentions, anyone could end up facing a jury.

No word about Neely’s drug levels? If it was fentanyl and Neely had a bad heart, he would be extremely vulnerable to death as a result of respiratory depression. Chances of death from a chokehold would be increased by the fentanyl. Neely could have been one step from heart failure. Actually all one had to do is tackle Neely and knock the wind out of him and, if he was on fentanyl, the toxic level of this drug would have been sufficient to trigger heart failure.
An example of respiratory depression is commotio cordis (the wind knocked out of one). An athlete gets hit in the chest with the ball and collapses, suffering sudden cardiac arrest. Without immediate care, the athlete will die. Instead of being a Marine, Daniel Penny could have been a football player. What would have happened if Penny tackled poor Neely?
Does one have to do a medical test for fentanyl to defend oneself and others? Are the public so stupid they have no clue about the effects of these opioids on respiration and exactly why such drugs kill?
