A young Mexican mom who strangled a man with a T-shirt after he raped her has been convicted in his killing and sentenced to more than six years in prison — in a case that sparked protests and backlash in the country.
The Mexico State Court found Monday that while Roxana Ruiz had been raped, she was guilty of homicide with “excessive use of legitimate defense,” adding that hitting her attacker in the head would have been enough to defend herself.
Ruiz’s lawyers swiftly slammed the ruling as “discriminatory” and vowed to appeal, arguing that it sets a bad precedent in a country plagued by gender-based violence. “It’s sending the message to women that, you know what, the law says you can defend yourself, but only to a point,” said Ángel Carrera, Ruiz’s defense attorney.

What if she hit her attacker in the head and killed him that way?
I’m assuming she killed him either during or just after the rape. Either way she had reason to assume the attacker would kill her once he was finished. Self defense.
This is a repost of an earlier story. Let me be the first on this thread to state what others have already said.
She’s lucky she did not live in New York. Alvin Bragg would have given her a much longer sentence.

What if she hit him in the head, but it didn’t stop him and he raped and killed her?
Its the same legal ruling that you are not allowed to murder an attacker when the mortal threat is not there. Or keep attacking and murdering someone after they are incapacitated. Theres a line where self defense can cross into murder.
Now, can people understand what she did and why? Sure. Does it cross the line and go from self defense to murder? This time the court thought so. One of the criteria is if you can disengage and get away, theres no justification for killing.
Revenge killing, while in many cases, understandable to many people, if its not necessary for saving your life, its going to be considered murder. Ultimatsly the court believed that in her particular circumstances, she did not need to go that far.
Other than the defendant and the deceased, who else witnessed this sequence of events?
Personally I probably think she wasn’t using excessive force.
Reminds me of the 1964 case in Korea where an 18-year-old woman was sentenced to six months in prison after being convicted of biting the tongue off of her rapist. She recently asked for a retrial of this case some five decades later.
Sounds like typical leftist/communist punishments these days.
