Federal appeals court blocks Biden’s vaccine mandate for US government workers

NEW ORLEANS — President Joe Biden’s order that federal employees get vaccinated against COVID-19 was blocked Thursday by a federal appeals court.

The 5th US Circuit Court of Appeals in New Orleans rejected arguments that Biden, as the nation’s chief executive, has the same authority as the CEO of a private corporation to require that employees be vaccinated.

The ruling from the full appeals court, 16 full-time judges at the time the case was argued, reversed an earlier ruling by a three-judge 5th Circuit panel that had upheld the vaccination requirement. Judge Andrew Oldham, nominated to the court by then-President Donald Trump, wrote the opinion for a 10-member majority.

Downey [after the verdict was read]  I don't understand... Colonel Jessup said he ordered the Code Red.

Galloway I know but...

Downey [nervously]  Colonel Jessup said he ordered the Code Red! What did we do wrong?

Galloway It's not that simple...

Downey [anxiously]  What did we do wrong? We did nothing wrong!

Dawson Yeah we did. We were supposed to fight for people who couldn't fight for themselves. We were supposed to fight for Willy.

No one here is going to debate your lies about a flawed but otherwise great man like Trump.

What everyone here should note for their next doctor visit, the nurse that enters the room may very well be the raving lying lunatic mominc.

“Judges are important. You Never-Trumpers do not realize what a bullet we dodged by having President Trump nominate judges for four years, rather than Hillary Clinton selecting those who would decide Constitutional issues.”

AMEN to THAT! Wisconsin has a HUGE battle on right now for a WI SC seat. It’s all about abortion - which I’m not sure anyone cares about anymore, other than the mouth-breathing, frothing Socialists in this state.

Wisconsin has a Constitutional BAN on abortions. Since Roe v. Wade was overturned that means NO ABORTIONS. Period. And guess what? REPUBLICANS in our state have already introduced legislation to make exceptions for rape, incest and the life of the mother! Gee. Who ‘da thunk it? How extreme! *SNORT*

“Safe, legal and RARE.” ~ Their god ‘Slick’ Clinton (!)

My guy, Dan Kelly (R, WI), is a Constitutionalist, and is labeled as ‘AN EXTREMIST’ in any and all ads from his awful opponent, LOL!

Victory would have been to stop the mandates on anyone!!!!

Sure people can choose to not work. But so can government workers. We all need to be free.

Prayers to Heavenly Father to Guide and Save us 🙏.

So the Chief voted too?

Yes and per opinion, total of 17 Circuit Judges voted (or decided) as follows:

(10) Majority opinion by Andrew S. Oldham, Circuit Judge, joined by Jones, Smith, Barksdale, Elrod, Willett, Ho, Duncan, Engelhardt, and Wilson, Circuit Judges

(2) Stephen A. Higginson, Circuit Judge, joined by Southwick, Circuit Judge, concurring in part and dissenting in part

(1) Haynes, Circuit Judge, concurring in the judgment in part and dissenting in part

(4) Carl E. Stewart, Circuit Judge, joined by Richman, Chief Judge, and Dennis and Graves, Circuit Judges, dissenting

Judge Douglas was not a member of the court when this case was submitted to the court en banc and did not participate in this decision.

Judges are important.

Very important. The following cases were decided by 5-4 vote of Supreme Court Justices. A single person kept the law from being decided the other way, think about that:

Planned Parenthood v. Casey (1992) (affirming Roe v Wade)

Bush v. Gore (2000) (FL vote recount)

District of Columbia v Heller (2008) (2A rights)

Citizens United v FEC (2010)

National Federation of Independent Business v Sebelius (2012) (Obamacare)

Burwell v. Hobby Lobby Stores (2014)

Amen to that. If nothing other than that, Trump was a godsend.

And he did much good in other areas, too.

I seem to recall the phrase “GI” from time to time.

Yes, they are government workers.

Looks like it took FIVE - not one.

Looks like it took FIVE - not one.

If the vote on deciding a case is tied 4-4 and there are 9 votes, how many votes does it take to swing the vote 5-4 in one direction or the other? Hint: the answer is not 5.

It’s kinda like the ‘winning’ shot in basketball, just at the buzzer.

Sorry, but if the team’s FIRST shot had never gone in, they wouldn’t have won the game with a buzzer beater.

If the vote on deciding a case is tied 4-4...

Assuming they vote one after another and not all at once??
