Smokers have access to free assembly in private venues while political parties have Article II, section 1 and Fist along with the 12th amendment, Apples/Oranges. Madison hated political factions, but said you can't have freedom without those pesky factions.
Smokers are not political factions.

I’ve been pushing that idea on forums for months...if the Dems got rid of statues then they must, in order to be consistent drop their name(since they advocated for slavery in a big way and pushed Jim Crow and segregation) and find a new one. Hahahahahah!This will be fun to watch!

Nice ‘hoist you on your own petard’ but not Constitutional at all due to free assembly, etc... This would affect 'Free Assembly'. They could still meet and have rallies and operate as a unit. They just could not have access to the state-wide Ballot. Here in Florida, local elections, county offices, mayors, city officers, school board, Superintendent, etc. are deemed 'Non-Partisan'..................
