New Mexico downgrades manslaughter charge against Alec Baldwin in ‘Rust’ shooting

New Mexico prosecutors have downgraded felony charges against Alec Baldwin and the armorer in the fatal “Rust” shooting, removing the threat that either could spend years in prison.

Baldwin and armorer Hannah Gutierrez Reed were charged last month with two counts of involuntary manslaughter for the Oct. 21, 2021, death of “Rust” cinematographer Halyna Hutchins on the movie’s set south of Santa Fe.

I totally agree. Such a charge is unconstitutional. So take your pick:

A. The prosecutors are incompetent.
B. The fix was in. “Hey, Alec. We’ll charge with something serious. But no worries. It will go away.”
C. Both A and B.

Wasn’t her first gig as head armorer.

She had been on another movie with Nicholos Cage, “The Old Way”. The cast and crew from that movie were less than impressed with her safety and attention to detail.

Perhaps the prosecutors fear jurors might view a 3 year mandatory sentence enhancement as excessive, and therefore acquit Baldwin, whereas if they do not feel responsible for imposing “harsh” punishment, they are more likely to convict.

The old statute required that the prosecution prove that Baldwin “brandished” the firearm, which he obviously did not do. So this idiot prosecutor charged him under a law that was passed AFTER the shooting, which eliminated the element of proof of brandishing. If the only thing that had changed was the penalty, that would not be an ex post facto violation (the prosecutor would be limited, however, to seeking 3 years’ incarceration). Taking out an element of proof from a statute makes it a different crime and an ex post facto violation.

I loathe Alec Baldwin and would not lose a minutes sleep if he wound up in prison.

That said, Merle Haggard spent 2 years in prison and came out determined to be the next Johnny Cash and boy did he, big time. Then, Ronald Reagan pardoned him.

Arguably, Baldwin could just accept responsibility for being the dumbass that he is and plea bargain for a year in prison.

I don’t wish to compare a punk like him to a man like Haggard but if he wants to have a career after this is all over, accepting responsibility might help his woeful reputation.

Yeah, they probably could have charged him with a more serious form of manslaughter. This charge has a maximum sentence of 18 months!? They threw in the gun charge which they knew didn’t apply. That is how you fix things for $$$s.

A real man would do that. But Baldwin is not a real man. He’s just another Hollywood phony. And he’d immediately fire any attorney who’d suggest such a thing.

As a side note, many years ago some famous American actor (I forget who) was convicted of marijuana possession in the UK. He was in the States at the time. But he accepted responsibility, voluntarily went back to the UK, and served his time.

I think I got that story right. I just wish I could remember who it was.

Okay, I will play what IF:

Take away Baldwin from the whole incident and replace yourself. You are an ACTOR on a movie set. You are called to shoot a scene. The armorer hands you a pistol. You would NEVER, EVER, think that there was real ammunition loaded in the weapon. The director calls action and you point the gun and pull the trigger. The young woman next to the camera drops.

What are YOU as an actor guilty of ?

You didn’t load the gun. The armorer did.

Now, as producer of the movie. Yes, he is liable. Not as an actor.

Negligent manslaughter.
