The film’s armorer will face the same charge. A cinematographer was killed when a gun Baldwin was rehearsing with went off. There was not supposed to be live ammunition on the set.

The thing is that there was nothing in the script about pointing a gun when the woman was shot.

It was a rehearsal. There was no reason for the gun to be in his hand, let alone firing it.

baldwin broke 17 specific onset rules of gun safety- (I had the chart at one time which i posted in previous articles when the incident/shooting first happened- i can’t find it now)
there is no way he can blame this on anyone else and walk away a free man- while others can share in the guilt, he personally was responsible for ALL gun safety protocols since he was the last one with the guns and should have gone over all the safety rules himself
The golden rule- Every gun is loaded whether you think they are or not
Another rule is never rely on what others tell you about a gun- check it yourself, always.
The person who the gun is pointed at should check the gun themselves as well-
there are no do-overs! Guns are not toys- Even prop guns! blanks can also kill- depending on the type- The one pointing the gun MUST know what they are pointing and what is in the gun they are pointing- they are the final safety check. They can’t just take someone else’s word for it like Alec is trying to do while claiming innocence!

That doesn’t mean I don’t believe there might have been negligence, just don’t believe it rises to the degree of a felony.

This discussion is moot, though, because New Mexico does not even recognize a crime called negligent homicide.
It defines involuntary manslaughter as follows:
B. Involuntary manslaughter consists of manslaughter committed in the commission of an unlawful act not amounting to felony, or in the commission of a lawful act which might produce death in an unlawful manner or without due caution and circumspection. (Emphasis supplied by me.)
It's even a bad idea to point a toy gun at somebody, because the other person (or somebody observing) may not realize it's a toy gun and draw on you.
It's the main reason I never bought toy guns for my kids. Not because I have anything against guns but I didn't want them forming unhealthy habits with guns. On the other hand, I am all for kids getting real guns with the proper instruction on how to handle them.
Baldwin needs a perp walk, too.

Not a lawyer but I believe “involuntary” would be easier to prosecute and take away a lot of the excuses we have already heard (did not know the gun was loaded, gun fired itself and so on).
He failed to check the gun when he got it and then he pointed it as someone and then he pulled the trigger. The only difference between this and first degree is his intent (which would be difficult to prove).
Will he get off, perhaps, but waiting in the wings is the woman’s family who will (most certainly) file a civil lawsuit. Baldwin WILL pay a price for his action.
It wasn’t the armorer’s fault she obviously lost the gun around the set there somewhere. If the crew was shooting the pistol around the area there might be ammo tickets for .45 Colt ammunition in some nearby store. That may have been the only functional real weapon in the property room, not a stage prop or dummy.

The civil suit filed by her family has been settled out of court already.
Well he was practicing a ‘cross draw’ which is a harder draw to get right- harder to get the right timing on pulling the trigger as the gun is moving in a horizontal move- if you aren’t used to it- it can be tricky timing it right- but noone hsoudl have been standing directly in the line of fire - especially without any protection liek a shield-
According to set folks who have commented on the issue- shields were supposed to be used to protect the camera folks incase something did go wrong— they apparently didn’t have them or use them=- and the gun shoudl not have been directly pointed in the direction of camera people- there are angles that can be used to make it appear to be in the direction, but aren’t, but baldwin obviously aimed directly at the woman when he pulled trigger- again, with no shield inpalce supposedly-
It was a tragedy all around- a tragedy due to Gross Negligence - and alec should have kept his mouth shut after apologized for his own act of gross negligence- but he didn’t- he’s trying to blame everyone else- He could have had a modicum of sympathy from the public- instead he has become one of the most loathed people in America because of his actions

I hope they got a ton of money from him, but the settlement amount was not publicly disclosed.
