I hope he does time. Nothing like months/years in the Graybar Hotel to give an arrogant SOB some humility. It’ll “wipe that smirk off his face”, as Dad used to say.

The case I linked to lays it all out.

If his action was "reckless" - i.e. so incredibly negligent (in the judgment of the jury) to constitute implied intent, then he is guilty of "reckless conduct", a misdemeanor - but that misdemeanor creates a felony *murder* charge. If he is not guilty of that level of negligence he may still be guilty of "unlawful manner manslaughter", another way of saying "without due caution and circumspection". That would be a misdemeanor and won't trigger a felony murder charge.

That's probably what's really going on here.

Last thing I recall reading on the topic is that the supplier of the guns and supposedly dummy ammo is the one who mistakenly put live rounds in the order which was sent to the movie set.

The live ammo came from crew members who acquired it for recreational target practice after hours. It is possible that the Armorer was involved in ordering that supply. The exact person who ordered the live ammunition has not been publicly identified. The crew members who participated in the target practice have not been publicly identified.

To be sure, neither of those activities was a crime. They were just stupid risks under the circumstances. Stupid risks accumulate.

The presence and unsupervised handling of live rounds on set was one of the safety issues that caused many of the previous crew members to quit.

By definition, he is guilty of manslaughter. Plain and simple.

The armorer should be charged with negligent homicide.

IT is his ONE AND ONLY JOB to make sure the guns are safe.

I would have been OK with Baldwin not being charged at all, except for the fact that he fired the good crew and hired the incompetent crew.

Was the gun a revolver or semi-auto?

I have seen someone load and rack a semi-auto and then hand it to a newbie... who immediately puts their finger on the trigger (where it’s supposed to go, right?)

I took a friend to the firing range about a month ago and I would not hand her the gun until I got it through her head NOT TO PUT HER FINGER ON THE TRIGGER.
