Biden already admitted guilt — he’s just betting Garland doesn’t prosecute him, or Trump

There will be much to chew on as the criminal investigation of President Biden by the newly appointed special counsel, Robert Hur, unfolds. For now, my question is: Have we already, in effect, witnessed a guilty plea?

In announcing Hur’s appointment, Biden Attorney General Merrick Garland laid out the facts of the case that drove him to the decision. Biden, while he was a private citizen after the conclusion of his term as vice president, retained batches of classified information in unauthorized locations.

That is enough evidence of a federal penal offense to warrant a criminal investigation and potential prosecution — which is what’s necessary under Department of Justice regs to trigger the appointment of a special counsel.

The reaction to the special counsel appointment by Richard Sauber, the lawyer Biden has brought into the White House to help deal with investigations, was remarkable. He said the president was confident that the special counsel investigation would find that the documents in question were “inadvertently misplaced.”

That’s not a defense to a charge of mishandling classified information. It is tantamount to an admission of guilt. For conviction, federal law requires prosecutors to establish that the defendant was grossly negligent. There is no need to prove that an accused was trying to harm the United States; just that he was trusted with classified information and carelessly flouted the standards for safeguarding it.

So it appears that Biden is not challenging that the documents were classified, that the locations in which he kept them were not authorized, and that he failed to keep track of them. Why have an investigation when all the elements of the offense are established?

They can, but the Judge Berman decision in 2012 over Clinton’s classified tapes pretty much torpedoes any chance they have of conviction. The defense could rest after the persecution presents their ‘case’ and move for a directed verdict. IF it went against them a perfect appeals court slam dunk - or supreme court if the judges on the appellate court don’t mind looking like fools publicly. Usually their ego is too big to allow that to happen. And President Trump has the money to just keep going up the ladder.

Concur.

Biden will have to resign to allow the federal prosecutorial system to retain at least some shred of credibility. Like Ford, Kamala will pardon.

That may well be true (I’m certainly no lawyer) but a conviction isn’t necessary.Charges will be more than enough to derail any chance that DJT has of returning to the White House. Why? Because a good percentage of the 20% of voters who are called “independents” wouldn’t even consider voting for him,whereas a pretty fair percentage of those same people did vote for him in 2016.

Jack Smith, Garland’s designated hatchet man has specific orders as to how his investigation is supposed to conclude. He is the sort of guy who would work for Pol Pot. He’ll get it done. He’ll fabricate a chain of vague legal precedents, misinterpretations, blatant misrepresentations and sundry tangential statutes and present it to Washington juries.
One jury will indict, and the next will convict.

Biden will probably get the boot simply to reinforce their actions against Trump. I pray they pull something out of their ass to keep Joe in office. If he gets the ol’ bum’s rush, it’s a dead certainty Trump will face prison.

I believe their strategy is he will do the investigation long enough that stays under the reader, and after everyone forgets about it he will pardon himself before potentially leaving office.

Yep, saying it was a mistake, etc, is just admitting guilt, because you are admitting you were negligent in handling the documents.

In Trump’s case, he admitted no such thing. He (or his lawyers) maintained that the documents had been unclassified (putting a basically impossible burden of proof on the government to prove otherwise), and thus there was no possibility of mishandling them.

Yes,delay just might be their strategy. However,can a President can pardon himself? My gut tells me that that's not possible.

Thinking the same. Heard that sitting POTUS can’t be charged so they’ll charge Trump sooner and Biden later and in that way neither one can run in 2024. imho, Dems don’t want Joe to run; they know he’s not qualified now and surely won’t get through 4 more years.
