Depends on the Jury.
The perp came in waving a pistol at everyone, with intent to rob everyone. The perp chose the time, place and method of his extermination.
I would have been good with the hero, unloading his gun on the perp, going to his car/truck, grabbing his range bag and spare magazines, and cycling another 10,000 rounds into the perps body. Starting with the little toe, and doing as he pleased.
There is absolutely NO LIMIT whatsoever on what the perp can do to an innocent victim; yet, limits want to be placed on the hero, who placed himself in danger, to protect the innocent.
The perp forfeited any expectation to mercy, humanitarian treatment, surrender or life; when he pulled his pistol out and became the threat. It’s just that simple, imho.
The threat had not passed. The criminal scum was pacing back and forth in the restaurant.
Robbing a crowd of people needs to become expensive again. /s

I saw an interview with the ADA and even she said she thought it was clear cut self defense but they were going to puzzy out and let a grand jury decide. That guy will never go to trial.
If you have only seen the video where the picture freezes once our Hero draws down on the perp, then I can understand the SMH.
However, there is a full video out there that I've seen where our Hero shoots the perp 8 times, including walking up to him while the perp is lying motionless on the ground to cap the perp for the 8th time while standing over him.
My training was "shoot until the threat stops." Lying motionless on the ground has pretty much stopped the threat.
That to me is getting very close to manslaughter, but in my eyes he's still a Hero.

Yes, indeed. But it will be the local DA who prosecutes the case. And DA’s have a lot of power in that regard. They can look at the law, and be lenient. Or they can look for ways to charge to the max. Then a jury will decide.
This isn’t New York Bill. In Texas the number of shots is meaningless. You shoot till the threat is down and 100% out of the fight.
