Finally! It's a shame it took so long and that the patriarchs of the family passed away before they could see justice done.

Wow!! I NEVER thought I’d see the day that a hardcore leftist institution would ever pay up?

I don’t think we ever heard the amount of the final settlement of Nick Sandman against the MSM.

How many other judgements against leftists have actually resulted in the guilty paid? Or even responding to a subpoena (see “Holder”)?

The insurance company was waiting to determine an on-going revenue that includes premium payments for “liability”.

They are very comfortable that Oberlin will continue to admit students now that the Biden Loan-forgiveness plan is going nowhere.

I trust that wherever the patriarch may be, I would guess either heaven or purgatory, but I’m Catholic and can’t read souls, that he is aware of what transpired and takes far more satisfaction in true justice now than he would have in this life.

I believe that other people, who do deserve justice on the natural level in this life as well, may need to get their consolations in this life because they will be hard pressed to get a cup of cold water in the next.

Nice to see justice finally done, but what about the instigators of these false accusations against the Gibsons? I suppose the faculty and administrators still have their jobs and the students have either joined Antifa or the Biden Administration. Too bad they weren’t also hit in the law suit.

I am not sure that a defamation aware is taxable. It is not “income”, like an insurance payout it is compensation for something lost, and the award represents the value that the jury appraised the loss. Any money going to the estates of the deceased will be taxed like any other inheritance. If the award was to the corporate entity Gibson Bakery, they owners would have to pay capital gains tax on the additional value when they sell.

A long time ago in California they implemented the "deep pockets law". Regardless of who is at fault, the party with the biggest pockets will be forced to shoulder most, if not all, of the financial penalty.

If Ohio has similar laws, then the individuals involved escape any financial penalties.

In a fair world the individual percentages of burden would be determined and the penalties divvied up accordingly. But in that case the Gibsons might have only received half of the money and would be trying to squeeze the rest out of the students and faculty members for years to come.

I wonder how much they cleared? Is it still standard to pay the lawyers 1/3?

This is one of the rare cases where the lawyers likely earned their big payday.

Most attorney/client contracts have a provision that it is more like one-half of the amount recovered should a trial or appeal be required. It varies, but I wouldn’t be surprised if that was the case in this instance. The firm spent years on this case with the majority of their firm’s resources geared towards it almost exclusively. There was a lot of expenses that they probably fronted to be reimbursed upon recovery. Meanwhile, their office overhead still had to be paid each month. However, some attorneys do reduce their fee somewhat in high profile, high dollar cases.

I agree. They put their all into it and refused to back down. You can tell the attorneys believed in the rightness of their clients’ position. They did amazing work and researched the law that supported their clients’ case and their pleadings and briefs were well-written and well-supported by law. The Oberlin attorneys actually made a couple of errors in procedure that did not serve their clients well.

“The Gibsons have collected the over $36 million owed them.”

They should donate it to a legitimate charity, like a Trump PAC.

IIRC, a couple weeks ago Sandman requested that Elon release any emails by FBI and cohorts regarding him. He might have a few lawsuits on deck if that ever happens.

Not sure, but I don’t think this type of income is taxable. Hope not.

Most states allow suits against all involved parties, but it’s a lit easier for the attorney to just concentrate on where the money is.

_____

What a snarky and unnecessary comment. I have no idea of the family’s political leanings and it has no bearing on the case. The incident that was subject to the lawsuit happened almost six years ago. The family suffered great financial and reputational harm. The family reported that the stress hastened the death of two elder family members.

Gibson bakery, which had been a long-timed business in the community for decades was on the verge of bankruptcy and seriously in debt due to the actions of Oberlin administrators and students. Students at the college still refuse to frequent the business so their business losses will extend into the future. The family were due every dime of the jury’s award. By the time they clear their debt and make all the several different family members whole, the sum will barely return them to even keel.
