Former FBI Deputy Director Andrew McCabe said Wednesday on CNN’s “The Lead” that Attorney General Merrick Garland’s speech about the Oath Keepers’ conviction for seditious conspiracy in connection with the January 6, 2021 Capitol riot was a direct message to former President Donald Trump and those who worked with him that the Department of Justice can prove sedition.
Guest anchor Kasie Hunt said, “Let me ask you about what we saw in the trial. Do you think the events of the last 24 hours have changed the calculation for the Justice Department in terms of whether or not to prosecute the former president since they were able to secure this conviction?”

In a D.C. court they can convict Trump of dancing with too many angels on the head of a pin. Or any other thing they charge him with, such as illegally causing the sun to rise in the East.
They can’t and won’t even try.

I'm just a country lawyer, but I think to be seditions, or to be an insurrection, you must have at least a theoretical possibility of succeeding.
If you introduce evidence of how long the processes of government were interrupted, I would do that by calling Nancy Pelosi to the stand. You start by asking her "For how many DECADES was the joint session vote delayed on January 6th?" As she sits there puzzled, you withdraw the questions and ask "Ms. Pelosi, then for how many YEARS was the vote delayed?" followed by months/weeks/days and finally hours. At some point even the most dim-witted juror gets the point.
It does not mean what was done was correct or justified, but it was not a sedition or an insurrection. I would describe it as a disorganized low-grade riot. But this threat to democracy bullshit is betrayed by the fact that the joint session resumed roughly 5 hours later. By definition, something that (seriously) threatens our democracy or the processes of government will not be recovered from that lightly.
D.C. is 95% Democrat.

Did they ‘prove’ sedition or conspiracy to commit sedition? I think there’s a difference. But no matter what D.O.J. might or might not have as evidence, Trump tried before a D.C. jury will be found guilty.
A DC court will convict Trump without the Prosecution even making a case.
