American Bar Association under fire for proposal to abandon LSAT after study shows minorities score lower: Recommendation follows a study that found black test-takers score 11 points lower than the average for white and Asian test-takers.

The American Bar Association is under fire after taking steps to abandon LSAT entrance exam scores as a law school admissions requirement after a study showed that minority applicants score lower.

The Council of the ABA Section of Legal Education and Admissions to the Bar approved the proposed standards revision earlier this month.

The proposed change now goes to the association's policy-making body, the House of Delegates, for review in February. "But final approval to change ABA Standards and Rules of Procedure for Approval of Law Schools rests with the council, which serves as an independent arm of the ABA for the accreditation of the nation’s law schools," said Bill Adams, managing director of ABA accreditation and legal education.

The vote comes after a 2019 study found that black test-takers score 142 on average, 11 points lower than the average for white and Asian test-takers. The 50th percentile is approximately 152 on the test, which gives scores ranging from 120 to 180. The Law School Admissions Council, which administers the LSAT, does not readily publish data about scores by race.

Rep. Greg Steube (R-Fla.) told "Just the News, No Noise" TV show last week that he wishes the LSAT was not a requirement when he was applying to law schools.

"I can guarantee you that's going to have an effect on their schools' bar passage rate if they do away with that," he said.

"But again, it's another example where it's identity politics or, you know, they're more concerned about affirmative action and race than they are the people that can intellectually pass the rigors of law school and become good lawyers," Steube said.

The Wall Street Journal editorial board blasted the ABA move. "The American Bar Association's move to discard objective tests won’t enhance diversity," the board wrote on Thursday. Without the testing, the board argued, students will arrive at school less prepared and unready for the eventual bar exam, which it said may be targeted for elimination next.

Sixty law school deans also signed a letter to the ABA in September stating that eliminating the testing requirement will "diminish the diversity of
law schools' incoming classes."

The possible scores range from 120 to 180, a range of 60. So 11 points lower is a really big deal.

Everything is handed to blacks, thats why they won’t put in the work. Would you work hard to get into college if you could get in and get through while still being a big fu#k off? If you wanted a good paying job with the government that you knew you’d have for life and be practically unfirable would you be a conscientious, punctual,and honest employee? If you knew there were government programs out there that supported your race financially in practically every situation in your life, would you not exploit that to the fullest. The successful, law abiding, professional black people in this world who actually did put in the time and do the work are an inditement of the rest of the entitled bastards.

Totally agree ... the problem is not the LSAT or whatever testing is being used. They are after-the-fact measuring devices.

The problem, if there really is a problem, comes before the testing and is a multi-faceted issue. Race may be a factor but it is a small one. Family upbringing, early education, even where one lives all factor in to what one receives educationally.

Blacks are scoring lower on these standardized tests because the applicants are less qualified than their non-black peers. The real problem is that the flaw in affirmative action is exposed; once you admit unqualified students and they can’t get a job after the years (and money) of school, you end up with unemployable, indebted angry blactivists.

As we go forward, if you need a lawyer or a doctor, get someone born in the last century. I know that’s nearly all of them now, but 10 years from now, it’s going to be noticeable.

Aaahhh yes the coddling whites and the do anything to beat the system blacks are at it again... That’s right... Blacks are too stupid to pass the test so just give them a passing grade. That’s the message smart people see.. others... Well they see it as a easy carjacking...

Why does the report single out averages?

What is the TOP score by a minority? Black, American Indian or Samoan?

If the top minority score is near perfect, then the problem is identifying those who are not likely to succeed. The top score will almost certainly succeed.

My Dad took the ACT at the end of the Vietnam War. In his 50’s, Mom had just passed and he was working two jobs while raising the last three kids.

So no studying or prepping for the exam.

And he had the first perfect score that the university had ever seen. One of only a couple that year, in the whole country.

So is it the education, the environment or the man himself that made him so great?

And here we are worrying about the bottom end of the scale?

Well, make them lawyers. Better than making them engineers.

Although I guess it is already here ... Passing the PE exam isn’t as difficult as it used to be, based on bridge building examples from across the country.

There should be no private law firms. The law is total invention of government. Its maintenance, application, and enforcement are facilitated under complete government supervision. Democrats have told us for years medical care is a “right” even though it is generally privately administered. But while the complete utilization of law at every level is a government function, we must pay heavily for this interaction with our governments. It’s good to write the laws.

Some people are naturally more intelligent. Others may have the brain power at birth, but poor nutrition, poor health, abuse, a chaotic life, and garbage schools can seriously impact their future prospects and success path.

I’m seeing it among my children’s friends. Smart young people with parents that never prepared them for the path or told them how to get there. After they graduated high school, they got tossed out with no plans.

Lazy parenting.

Meanwhile, my eldest graduates with his Bachelor’s degree in 2 weeks, the middle child is working on his, and the youngest is researching colleges while still in high school.

We told all our kids we would cover their Associate’s degree; they had to fund the rest. They didn’t slack or live on campus to control costs and maintain scholarships.

If you get a crap score on the placement test, you’ll probably not do well in the intro courses.

If you can’t hack the intro courses, you’ll absolutely fail - in spectacular fashion - the advanced courses.

If you fail the advanced courses, you had no business in that program of study - or that profession - in the first place and you will not be competent to work in it.

That’s what the placement tests are for.
