According to Scott Ritter, the Ukrainians deliberately launched the Ukrainian S300 missiles into Poland. NATO knows it is a Ukrainian missile, and it was deliberately fired into Poland. But Zelensky might not know the truth. There are elements in the Ukrainian military who would do it unilaterally, Ritter believes.
The Ukrainians want Patriot missiles and a no-fly zone since they are losing badly, especially under the barrage of missiles from Russia. They’re losing their energy systems. Zelensky and his military don’t seem to care if they start World War III.

Ritter gave Z a possible excuse, saying the missile could have been launched without his order, by underlings trying to cause trouble, apparently.

There’s a zillion things that if unfolded differently, could have changed reality as it is today. That’s why consequential damages are rarely admissible in court.
When I first heard the news, I assumed it was a missile malfunction. I won’t be surprised if it just fades away like so many other stories.
Ultimate blame goes back and back and back. Adam blamed Eve. Eve blamed the Serpent. We could say it started there or maybe blame God for making everything. Or maybe we could admit that Putin being evil does not excuse Zelensky being evil.
Ukraine needs Poland’s help.
The government of Ukraine (or any sane and loyal Ukrainian) would not risk making Poles angry at Ukraine.
Two points:
Not all Russian missiles would have to be launched from the east, Russian planes and naval assets launch most of them (we are told) and there is Russian air space to the north over Kaliningrad oblast as well as naval assets that could be in the Baltic even to the north of Poland although I don’t know whether Russia would risk having missiles overflying Poland. Also Russian planes are probably free to operate over Belarus.
Second point, after a missile interception, fragments or partially disabled missiles could in theory fly towards the ground at any angle, the impact point was barely inside Poland’s territory along an uneven border, so that theory is not outlandish.
Anything is possible however. I do not strongly back either side in this and would like to see a negotiated settlement at the earliest opportunity.
I said earlier that I think this was either an errant missile (anything that is mechanical can malfunction), or it was a missile that was intercepted by a Ukrainian surface to air missile, and the debris ended up across the border. I do not think it was an intentional attack on Poland by anyone.
I suspect the Poles had radar scanning the area and know why the missile got launched (Russian aircraft nearby).
An armistice would stop the killing.
And no party would have to give up any territorial claim or right.

I don’t know what courts you are referring to, but they are certainly not American courts. Consequential damages are routinely admitted into evidence, especially in civil cases and contract matters.
Right, wink wink, but since possession is 9/10 of the law...
