U.S. Supreme Court's Kagan says justices must find 'common ground' again

Liberal Justice Elena Kagan on Friday expressed hope that her colleagues on the conservative-dominated U.S. Supreme Court could get back to finding "common ground," saying it risked looking political by continuing to overturn legal precedents.

Speaking at an event at the University of Pennsylvania, Kagan did not explicitly reference the Supreme Court's decision in June to overturn the landmark 1973 Roe v. Wade ruling that legalized abortion nationwide.

But Kagan, who dissented from that decision powered by the court's conservative majority, argued that judges and justices should be "humble" and respect past precedents interpreting laws and rights that people build their lives around.

"If you give people a right, and then you take the right away, well, in the meantime they've understood their lives in a different kind of way," Kagan said during a discussion with UPenn President M. Elizabeth Magill. "So law should be stable."

Well she admits that Roe V Wade was made up by the Supreme court when they "gave" it to America. But I'll take her at face value. Does that mean she supports the second ammendment? since people have understood their lives in a certain way as to mean the constitution meant something? Oh no, no no no THAT right she wants to take away ASAP.

When they say “common ground” I always remember firstly this : Many years ago the gay special rights movement just “wanted to be left alone and live happily”.

Not that many years ago. They move fast. They lie about wanting something simple and agreeable and that's all, then they demand more and more and more. I was never fooled when they hid their leather chaps and feather boas and nun costumes and put on flannel shirts and khakis that they were being real and that they would or could be satisfied until they have all have catamites in their homes and are celebrated for it. And boy oh boy the are fighting for it and somehow they are winning.

Since Kagan has been on the court, she has been very quiet about her same-sex relationship. In my view, that should have disqualified her. I've never seen a homosexual who had not overturned a thousand realities to have “their world.”

Great points. I remember when both parties would decline to push through legislation with razor thin support because they didn’t want to anger Independent or on-the-fence voters. But that ship sailed long ago.

When’s the last time Kagan sided with anything conservative? And since when does the Supreme Court “grant” us rights? This is actually a Harvard law professor?
Rights are from the creator and Constitution, and the job of the Supreme Court is to test whether or not a law is constitutional.

Even -that- was not envisioned by the founders. The Supreme Court granted itself the right to judicial review in Marbury vs Madison.

…But even in a more typical term, approximately 80 percent of votes are in support of the majority opinion, and only about 20 percent of cases are determined narrowly. The 5–4 cases that get national attention are in fact somewhat anomalous…
