Frankly I’m surprised he was confined for 30 years. That was yesterday’s system of justice. Today’s would sentence him to a year of home confinement, on the honor system, for the same crime.

To be honest, I am surprised that no attempt was made on him, or to be more precise, no attempt made it to the point of firing off a shot.

Hey, I jist noticed they called it “custody” ... like he was in a holding tank for the drunks waiting to appear before the night court.

Not “prison”.

Hinckley was found not guilty by reason of insanity (NGRI). The idea of guilty mind, Mens rea, is an essential element of a legal finding of guilt in our system of laws. Usually intent is demonstrable and not contested. But the idea of an insanity plea, alleging that due to severe mental illness there may be no Mens rea, goes back as far as the Roman code of Justinian. It was said of such people that they could no more be held accountable than a wild animal.

While Hinckley no doubt fired the shots that wounded Reagan and Brady, he did not kill either of them, and was found to be operating under the delusion that his actions were justified. As a result he was confined for treatment, not in a prison, but in a secure hospital facility. Under our system of laws, such confinement is not considered punishment.

Under our Constitution, involuntary confinement results in a denial of rights, and the time of confinement must be limited to the time necessary for the original purpose to be achieved. That’s why there is no specific amount of time stated when commitment for treatment is mandated.

Hinckley was held for many years and eventually found to be sufficiently recovered that he no longer posed a threat to the public or himself. After repeated reviews by forensic psychiatrists and psychologist, it was finally determined that since he was no longer a risk to others there was no further justification for continued confinement.

There are whole books written about the Hinckley case and the insanity plea. They amply illustrate that the rule of law was followed. Conservatives respect and follow the rule of law. While the case is tragic the fact is that the invective spouted here has no validity unless you all want to scrap the law and go for blood lust. If so then you should quit calling yourselves conservatives and find for yourself some other more descriptive category.

With the posting of this story, life is confirmed to be upside down. One would be punished far more severely than he was were one try to kill Hinckley and leave him alive.

If only Jodie Foster had been comfortable coming out as a lesbian earlier, then maybe Hinckley wouldn’t have gotten obsessed with her.

So you see, it was really systemic homophobia that shot Reagan!

It’s also worth nothing that his story is probably encouraging to other would-be assassins. Some of them are thinking “if I can just fake crazy well enough, I may only do 30 years”.
