New York’s attorney general says her three-year investigation of former President Donald Trump uncovered potential crimes in the way he ran his real estate empire, including allegations of bank and insurance fraud. So why isn’t Trump being prosecuted? Attorney General Letitia James didn’t seek to slap handcuffs on the Republican this week, as some of his critics hoped. Instead, she announced a civil lawsuit seeking $250 million and his permanent banishment from doing business in the state. Like many things involving the law and Trump, the reasons James, a Democrat, opted for a lawsuit rather than a prosecution are complicated. For one, even if she did want to prosecute Trump, she doesn’t have jurisdiction under state law to bring a criminal case against him or any of the lawsuit's other defendants, including the Trump Organization and his three eldest children, Donald Jr., Ivanka and Eric Trump. In New York, the state attorney general’s office is only allowed to prosecute a limited range of offenses on its own, like bid rigging and payroll violations. Otherwise, the office must partner with a county district attorney on a prosecution — as James' office did with the Manhattan district attorney's office in a case against Trump's longtime finance chief — or obtain what’s known as a criminal referral from the governor or a state agency that has jurisdiction over the alleged wrongdoing.

“Potential” crime? Utterly meaningless. The author getting into his car is a “potential” crime. The author taking a dump is a “potential” crime.

This is something to pay attention to. They are coming to financially ruin every last deplorable conservative. The criminal code requires a burden of proof a crime has been committed. The civil system only requires a jury if you request one. The hurdle for a prosecution (now plaintiff) is very low in bringing a case and juries in liberal hell holes are a problem.

Strangely enough it was Mark Levin who suggested this tactic to be used against public officials by private citizens about a year ago when they refuse to follow the law. It was becoming effective. Now they are using it to ruin people and their friends, peers, family, and associates over their political views. And yes the left sees that as criminal. You may not serve time but you will be stripped of your assets.

Trump values property by its likely potential.

The bank values property based on what it can reliably get at a forced sale.

If you work hard to sell property, you will be able to get more for it.

Hard work pays. That concept may be foreign to a NYC Democratic politician, but it is a fact.

Not very complicated. There is no legal or factual basis for criminal charges. Anyone with a filing fee can file a civil lawsuit.

Letitia James ran for office and presumably was elected on the promise to go after President Trump and his family. This is obviously an unbiased administration of justice.

I wonder why AP didn’t include that bit of background in their story.

The two “geniuses” that wrote this piece doesn't realize there are no “cuffs” involved in a civil case. The remedy for civil cases is money, pure and simple, if “damage” to the other party can be proven. In this case, however, there is no “aggrieved” party. No one is saying, other than the AG, that Trump defrauded them. No one is claiming that Trump took the money and ran and didn't pay back his loans.

Sigh.....someone who writes this drivel should not be allowed to unless they understand the fundamentals of what they're writing about. But then, if we relied on “educated” liberals, who would write their hit pieces.

And for the record, my background is accounting and law.

“Potential crimes”? Can you imagine spending three years of your life trying to find a potential crime someone may or may not have done...with all this time invested so far you’d think something but there’s nothing.
