UPDATE: (Aug. 12, 2022, 3:13 p.m. ET): NBC News on Friday obtained a copy of the warrant used in the FBI's search of former President Donald Trump's Mar-a-Lago home in Florida, as well as the related property receipt. The FBI recovered 11 sets of classified documents in the search, according to the documents.
This week, in addition to having his private residence searched by the Federal Bureau of Investigation, former President Donald Trump was deposed in an investigation by the New York Attorney General’s office. There he apparently didn’t say much other than that he was asserting his Fifth Amendment right against self-incrimination. And here is what you should know.
The jury could be allowed to consider whether Trump asserted his right against self-incrimination because he has something to hide.
The Fifth Amendment allows you, me and Trump to refuse to answer questions if there is a genuine risk that we could face criminal prosecution based on what we say. But, and this is a big one, the Fifth Amendment does not protect us from a jury in a federal civil case judging us for staying silent and invoking our Fifth Amendment rights.

If there was no PROBABLE CAUSE of a crime BEFORE they conducted the search, then the search was illegal and anything they found is “fruit of the poisonous” and not admissible in court.
Any judge that doesn’t instruct the jury the opposite should be removed from the bench.

It is true that a jury can choose to construe the assertion of a 5th amendment privilege against self incrimination as an acknowledgment that a true answer would be incriminating in a civil case. They are not required to do so, however.
I am not saying this rule has any application to Trump’s circumstances.

A New York jury no less. It will be hard for Trump to get a reasonable jury pool. I think that is the bigger problem than whether he invokes the 5th or not. Even if Trump had answered every question perfectly that would not have been enough for some jurors brainwashed to hate Trump.

Da Fifth Amendment tables didn’t turn on all of Bonzo’s people who took the Fifth or those involved in the Russki Fake Dossier Scam against the President of the United States so I don’t see why the Fifth’s tables should be turning now unless people are right and America does have a two tier, banana republic, fascist style “justus” system. Them against us.
