Justice Department Says Militia Group Cannot Blame Donald Trump for Entering Capitol on January 6
The U.S. Department of Justice (DOJ) is arguing the founder and members of the Oath Keepers militia group who entered the U.S. Capitol on January 6 cannot blame former President Donald Trump for their actions.
DOJ lawyers argued Trump lacked the authority to authorize an attack on the Capitol, which should prevent Oath Keepers’ lawyers from blaming the former President.
The United States said in a filing:
President Trump did not have the authority to permit or authorize a conspiracy to forcibly oppose the authority of the government or the execution of the laws of the United States, nor could he have lawfully sanctioned the attack on the United States Capitol on Jan. 6 or any of the other criminal conduct allegedly perpetrated by defendants.
Trump’s critics often blame him for inciting the Capitol riot during a speech held hours before the breach. The House of Representatives ultimately impeached Trump in the aftermath of the Capitol riot.
Federal prosecutors also want the judge to prohibit the defendants “from arguing that any failure to act by law enforcement rendered their conduct legal.” Accused rioters often argue they were effectively let into the Capitol by members of the Capitol police.
The federal trial of Oath Keepers founder Elmer Stewart Rhodes and other members of the militia group is set to begin on September 26, Bloomberg reported.

Who believes anything the DOJ says?
Even if they agree with you, does it really matter what they say?
It was a pretty lame defense by those who crossed a bridge too far.
“Trump made me do it!” It sounds like, “The Devil made me do it.”
I’m thinking they’re doing this to protect whatever tact they might try and take in investigating the President.
It’s one thing for the DOJ to go after Joe 6-Pack, who can’t afford a lawyer. It’s another going after a billionaire who can afford the entire firm. And discovery could be a real bitch for the DOJ.
And if there’s no comm’s between the President and Rhodes or any other Oath Keeper, they have nothing.
If that were the case, the President Trump should suggest that Rhodes and his band of idiots stroll out to the middle of the Golden Gate bridge and take a giant leap for the sake of the country. Lets see what they do.
It really would be nice to see the CCTV footage.
Nothing from our government in the past two years has been factual, truthful, or anything other than clumsy psy-ops or misery in green disguises.
This will not stop them from arguing exactly the opposite when they file charges against Trump.

No - read it again. The Oath Keepers are - or at least were - apparently going to try to argue they were not responsible for their own actions because supposedly Donald Trump ordered them to do so. The government is arguing that isn’t a valid defense because Trump even as President had no legal authority over them to force them to do anything. They aren’t arguing Trump didn’t given such an order, so they have left this narrative open entirely.
If true, Liz Cheney is not a happy camper.

Not really - two different things. People are unfortunately getting excited over nothing and Breitbart, while everything is technically accurate in this article, seems to be trying to get the reader to reach a conclusion that the DOJ just declared Trump in their eyes did nothing wrong. They are merely arguing that Oath Keepers cannot use Trump as a defense against taking responsibility for their own decisions / actions. Their defense is supposedly that Trump ordered them to enter the Capitol, so he is responsible for what they did and they were just following orders. The DOJ is saying that isn’t a defense as Trump had no direct authority over them and could not force them to do anything and they are still responsible for their own actions.
