I’ve been thinking about the establishment of a federal law permitting abortions. Just as there is no right conferred by the Constitution, I am struggling with what the jurisdictional basis under the Constitution is available for a law. Maybe interstate commerce?

It’s nuts, because all the ‘Rat states will have just as many abortions tomorrow, as they have today, if not more.

What do the ‘Rat (DEM+RINO) Sinators have to fear? If abortion is so grande, they can ‘sell’ abortion to states, as all SCOTUS did was place the abortion discussion back into the public discourse.

Looking at that list of Senators, I did not see a single Constitutionalist on the list. However, I was surprised that not a single Extra-Constitutional Republicrat on that list

All matters not enumerated in the Constitution are reserved to the States.

The only other option is Amend it.

The letter says “We cannot stand by,” as the DEM senators simply stand by.

I’m not saying abortion is a power of the federal legislature, but it appears to me these senators are trying just as hard as SCOTUS to get th issue out of their scope, and into the executive’s.

Talk about open abdication and dereliciton. Do-nothing bunch of posers.

I recommend reading the opinion... I'm now in the middle of it (actually, around page 40). It is well-written and easy for us layman lawyers to follow (I skip over the footnotes and references, and follow the gist). It covers the questions you raise in your reply and so much more.

Let the communist states fund, pay and organize abortions from their own taxpayers.

One big battle will be to block federal funds from being used to fund pro-abortion states.

I believe the Supreme Court want Congress to pass laws, rather than having to find new meanings in the Constitution. They certainly said that Congress could require masks on airplanes, if they wished to do so.

second favorite play for doing an end run around the Constitution ( after activist judicial fiat ) is gross abuse of the Interstate Commerce Clause.

Bear in mind that, contrary to what they are saying, they know abortion is very UNPOPULAR with the majority of Americans, and that is why they haven't attempted to amend the Constitution, which is THE ONLY WAY TO FEDERALLY LEGALIZE ABORTION.

I think you are correct that they would have to make an "interstate commerce" claim, but that's a very thin reed. For example, the FDA may permit a particular medical procedure but I'm fairly certain that would not prevent a state from restricting it.

The only exceptions I know of, like sale of contraceptives, have been based on the same rotten branch of "right to privacy" restrictions. These old decisions are now ripe for being overturned.

They could permit the interstate sale of abortifacients by mail, but I'm not sure that wouldn't allow states to still prohibit their use.

Your right one in the court has said it’s time to address it.
If the left thinks they are pissed off now wait until that hammer drops.
