Federal judge lifts injunction on Alabama’s 2019 abortion ban after Roe v. Wade overturned

A Montgomery federal judge on Friday lifted the injunction preventing Alabama’s 2019 abortion ban from going into effect after the U.S. Supreme Court overturned Roe v. Wade, meaning abortions are now illegal in Alabama except in cases where the life of the mother is in danger.

U.S. District Court Judge Myron Thompson’s order in Montgomery federal court said that the legal underpinning for the injunction “no longer exists” after the Supreme Court’s decision in Dobbs v. Jackson Women’s Health Organization overturning Roe.

Alabama Attorney General Steve Marshall, the defendant in the legal challenge to the Alabama law, was granted his emergency motion Friday to dissolve the injunction.

The 2019 law, known as the Human Life Protection Act, makes abortion illegal in Alabama except when the life of the mother is threatened.

At the time, the law was viewed as the harshest in the country, with no exceptions for rape or incest.

Since its allowed for ‘the health of the pregnant female’ it should be mandatory that she have her tubes tied at that time

After all another pregnancy would be dangerous also ...

a rape should be reported at the time of the rape and the rapist (possible father) identified for criminal charges

Incest should also be reported at some time and the male relative IDed and charged

The judge acted appropriately in this case. No matter what side of the abortion issue you are on, he was correct in lifting the injunction. It is now up to the state Legislatures to decide under the Tenth Amendment.

LOL   Well, you know that is not actually true.   I believe a physician might say there could be a temporary condition that could be corrected or resolved before another pregnancy might occur.

There are no absolutes and forced sterilization is a bridge to far.

I personally believe that a woman should choose to do anything to carry a baby to birth in spite of a Doctor's opinion.   Babies can live and thrive even after only 22 weeks nowadays.

Willow was born at just 22 weeks' gestation, weighing 1 pound, 5 ounces. A doctor told the couple there was no hope that she would survive.

Donald Trump said the overturning of the landmark Supreme Court decision giving women the right to abortion “will happen, automatically,” if he is elected president and gets to appoint justices to the high court.

“I am pro-life,” Trump said during Wednesday night’s presidential debate when asked whether he wanted that decision, Roe v. Wade, reversed by the Supreme Court.

Trump said that if the ruling were to be reversed, laws on the legality or illegality of abortion would “go back to the individual states” to decide, which was the case prior to Roe v. Wade.

But when moderator Chris Wallace pressed him on whether he wanted the ruling overturned.

Trump said, “That will happen, automatically in my opinion!” because he would get to nominate potentially several justices to the court.

In response, Hillary Clinton said, “I strongly support Roe v. Wade.”

“I will defend Roe v. Wade, I will defend a woman’s right to make her own decision,” Clinton said.

She criticized Trump for having said in the past that a woman should be punished if she got an abortion when it was made illegal.

Trump fired back, saying Clinton was in favor of partial-birth abortions being legal, which meant that a fetus could be “ripped out” of a mother’s womb a day before she was due to give birth.
