-- Any fee on a CCW would be the equivalent to a poll tax. --

And yet 100% of the states that issue CCW charge a fee for that, and do not charge a fee for voting.

I agree with your sentiment. I find that governments are out of bounds by a fat margin, but the governmentsmake the rules, not me, and they will use force of voiolence to obtain compliance. All branches in cahoots that way, it's just a matter of line drawing to keep the people from broad open defiance.

Interesting from the ruling-—compares the right to bear arms to McDonald and Heller.

(1) It is undisputed that petitioners Koch and Nash—two ordinary, law-abiding, adult citizens—are part of “the people” whom the
Second Amendment protects. See Heller, 554 U. S., at 580. And no
party disputes that handguns are weapons “in common use” today for
self-defense. See id., at 627. The Court has little difficulty concluding
also that the plain text of the Second Amendment protects Koch’s and
Nash’s proposed course of conduct—carrying handguns publicly for
self-defense. Nothing in the Second Amendment’s text draws a
home/public distinction with respect to the right to keep and bear
arms, and the definition of “bear” naturally encompasses public carry.
Moreover, the Second Amendment guarantees an “individual right to
possess and carry weapons in case of confrontation,” id., at 592, and
confrontation can surely take place outside the home. Pp. 23–27

The governor of NY said the government has rights and that this outrageous decision will be fought. Amazingly dumb.

Like she's the offspring of Cuomo and Whitmer

The total number of Trump Article III judgeship nominees to be confirmed by the United States Senate was 234, including three associate justices of the Supreme Court of the United States, 54 judges for the United States courts of appeals, 174 judges for the United States district courts, and three judges for the United States Court of International Trade...wikipedia

And many thanks to President Trump...

-- I wonder if it makes the idiotic Federal gun regulation legislation currently working its way through Congress unconstitutional. --

No, it does not. And I expect SCOTUS to uphold red flag laws. They aren't much different from civil forfeiture. There may be some "as applied" cases that establish the details of what it takes to be red flagged, but those cases will simply be an instruction book on how to deprive people of rights without offending the court.

I expect SCOTUS to uphold red flag laws

Only if the right to due process is not infringed. Like forcing people to pay thousands for legal representation to prove their innocense

I live in eastern PA too and used to work in Easton, just next to the NJ line. If I missed my exit (forced into wrong lane bc of traffic etc), I would wind up in Jersey and instantly become a felon.

Clearly THAT needs to be challenged as blatantly Unconstitutional.

Pretty sure this is what will happen with red flag laws too. They open the door for massive abuse by a tyrannical government like we currently have.

Yes, I think this means a CCW issued in one state must be accepted by another.

Who wants to be the guinea pig?

“New York's Legislature considered the empirical evidence about gun violence and adopted a reasonable licensing law to regulate the concealed carriage of handguns in
order to keep the people of New York safe.”

The law has not kept the people of New York safe; it is more dangerous than some third-world countries.

The law's failure should be enough to convince a liberal judge to throw the thing out without considering the constitutional merits of the argument (they never want to consider constitutional arguments anyway).

Ya gotta start somewhere.

Given the number of states that “do” allow “constitutional carry”, and the lack of “shootouts in the streets” increasing, it will be harder and harder to maintain any reason for CCW licensing.

I’ll just say again, the courts uphold civil asset forfeiture. Red flag laws will probably include a judicial rubber stamp. Once at that level, it costs thousands to make your case.

The last thing you should want is to come to the attention of anybody in the government, because nothing good can possibly come of that. Well, it’s good for the people who make a living in the government, I suppose. Adds to the economy and all that.

The way I read the ruling, it sounds like it goes much farther than just the New York rule. It says individuals have a constitutional right to self defense with a gun outside the home. That would seem to me to strike down pretty much every restriction or licensing scheme for concealed carry nationwide.

Providing the licensing is not restrictive....which is up for interpretation.

I want to use this to push for national reciprocity where a CCW issued in one state is valid in all 50, just like a marriage license.
