Yes, they have to arrest him right away so that he can be promptly released on his own recognizance.

The perp here, if he is eventually caught, needs some punishment he will not be likely to forget, especially since it was apparently attempted murder. Maybe the answer is two forms of punishment. One could be imprisonment for a long term, but maybe that could be augmented with something of a more physical punishment.....something not soon forgotten, like a caning.

As recent as Frank Robert James‘ attack on the subway, the cops used camera footage to track his movements, I would expect there were cameras that caught this guys movements and provide a clearer pic.
