Criminal prosecution lies under prosecutorial discretion. This discretion can be abused with near impunity. There is a handful of abuse of discretion cases that resulted in penalty - Nifong being one that comes to mind. Shport of that, all that happens is the case gets tossed and the defendant is punished, sometimes ruind by the process. General Flynn, waco bikers, many other cases. Prosecutors have near absolute immunity, and courts and prosecutors play for the same team.
When there is no law, then there is no law
