The judge described the state's practice of rejecting ballots that arrived without a required handwritten date on the outer envelope unfair restriction of the right to vote.
A state appellate court on Thursday agreed with Pennsylvania GOP Senate candidate David McCormick and ordered Pennsylvania counties to tally more than 800 undated mail ballots and include them in vote totals they report for the neck-and-neck Republican primary race between McCormick and Mehmet Oz....

They are NOT valid ballots by their own constitution!
Just change the rules until you get the outcome you want..../s
This isn’t as idiotic as it may seem. My understanding is that these are ballots that don’t have dates written on them, but were obviously completed on time because they were received by Election Day.

Ooh, I just “found” boxes of ballots in the trunk of my car! By some amazing coincidence, none of them have a date! We don’t know if they are valid so we just have to count them - “democracy” and all that.

THEY’RE UNDATED!
That means they’re not postmarked by the Post office which means they could’ve come from ANY source.
If this ruling countermands established State Legislature law, it’s another example of a Judge re-writing election law. The Supreme Court found, in Bush v. Gore (2000), that election law can only be written by State Legislatures, not the courts.
But this judge feels she has a deeper understanding and just knows better.
This might turn out to be a HUGE victory for MAGA in every state and every subsequent election.
If SCOTUS hears this and rules that undated ballots or ballots w/out signatures cannot be counted, then it should be binding everywhere from now on. No more of this lower-court-crap with finding a sympathetic lefty judge to get around the voting laws.

I thought they did or at least one of them did. Basically he said to follow the law. No late ballots.

The judge decided that it was ludicrous to reject ballots without dates because election officials were accepting ballots with ANY dates on them — even if the voter filled in a date from 40+ years ago.
What happened to Alito’s stay from 2 days ago?

“Undated” means that outer ballot envelope signed by the voter did not have his/her handwritten date affixed.
Has NOTHING to do with postmark date.
