Michael Sussmann has been acquitted.
The acquittal is no surprise. This is a DC jury, after all. In the Roger Stone case, for example, we documented how a juror lied to get on the panel. (That judge didn’t care.) Making matters worse, the Sussmann judge wrongly allowed for a woman to remain on the jury, despite the fact that her daughter and Sussmann’s are on the same high school crew team. One can’t help but think that juror had her own daughter’s interests in mind – the cohesion of the crew team – when she reached a decision.
On the facts, there was more than sufficient evidence to prove Sussmann’s guilt. Sussmann lied to then-FBI general counsel James Baker in order to get a meeting to pass the Alfa Bank hoax materials to the FBI. Sussmann lied again during the meeting – stating he was not there on behalf of a client – in order to get the FBI to open an investigation into the Trump Organization’s purported ties with Alfa Bank. Later, during testimony to Congress, Sussmann admitted he met with Baker on behalf of a client. Billing records proved he had been working on the Alfa Bank project on behalf of the Clinton Campaign.
I won’t say the verdict doesn’t matter. Of course it matters. It would have proven that a DC jury can convict one of their own. It would have resulted in accountability for lying to the FBI. Not the gravest of crimes, but it is still a crime.
In large part, the prosecution of Sussmann was hamstrung by the FBI’s investigation into the Alfa Bank allegations. That goes to materiality. How can the lies be material if the FBI’s investigation was so sloppy? (Answer: they were material because the lies helped open the investigation in the first place.)
On the issue of materiality, look to the testimony of FBI Special Agent Curtis Heide, whose repeated requests to interview the source of the Alfa Bank information were denied by headquarters. FBI Headquarters didn’t want this thing thoroughly vetted - even though they demanded the investigation be opened. As we stated during the trial:
Relatively early on in the investigation - on September 26, 2016 - Agent Heide sent a message to Pientka, requesting an interview of the source of the Alfa Bank white papers. By that time, Heide knew the white paper was bunk. He received no response from Pientka. He repeated this request on October 3, 2016. Agent Heide’s requests were rebuffed by his liaison at FBI headquarters:
That’s not the say the public hasn’t benefited from the trial. The information disclosed during the trial was important to understand the broader Clinton/Fusion GPS/Perkins Coie effort to poison the public, the press, and the FBI with their Trump/Russia lies. This included:
Data from the Executive Office of the President of the United States, including data from the Trumansition period, was exploited by Sussmann and Rodney Joffe and then passed to the CIA.
Rodney Joffe was a longtime Confidential Human Source (CHS) – and generally a resource – for the FBI. Joffe worked with the FBI on cyber threats from countries like Russia. From former FBI Agent Grasso: “I’m sure the work that [Joffe] did touched on matters having to do with Russia.”
Joffe went to great lengths to make sure the Alfa Bank information he provided to the FBI did not go through his official FBI handler.
The decision to open the investigation came from FBI Leadership. According to one FBI Agent, “People on the 7th floor to include Director are fired up about this server.”
Perkins Coie partner Marc Elias provided updates on the Fusion GPS “research” to the Clinton Campaign.
And - Hillary Clinton herself approved of the strategy to disseminate the Alfa Bank allegations to the media. Per Robby Mook:
Q: Mr. Mook, before the break you had testified that there was a conversation in which you told Ms. Clinton about the proposed plan to provide the Alfa-Bank allegations to the media; is that correct?
A: Correct.
Q: And what was her response?
A: All I remember is that she agreed with the decision.
Where does Durham go from here? That’s the real question. We already know that the investigation into Rodney Joffe remains open and that Igor Danchenko faces trial this year. Whether there is more remains to be seen.

As I’ve said plenty of times before, Clinton and the like will only reap their rewards when they die. Until then, we are stuck with them.
These people cannot cash their ticket to hell soon enough.

They also had texts from Sussman himself confirming the government’s version of what he said in that meeting, so there was corroborating evidence.
Their motto: Choose Lies or Choose Death.

Not only that, but there is also the text/e-mail from Sussman stating what the prosecutor claimed.
DC Juries are why the Clintons and several members of their administration were not convicted in the 1990s. Recall their Secretary of Agriculture flatly stating that he did the thing he was a accused of (accepting gifts from meat producers) while on the stand, and the jury rendering a ‘not guilty’ verdict.
Charges were not brought against Hillary despite firm decisive evidence that she had directed the White House Travel Office firings because she didn’t actually have the authority to do so, and because the IC decided they couldn’t convict before a DC jury - even though he had her dead to rights.

Trump should have cleaned the whole government... department by department!
Maybe he didn’t know the feel of the nation... and figured if he could keep corruption in some sort of control.. he could fire them ALL in his second term.
The second term is long coming and in the meantime a mass is heading to out southern border... By the time anything is done with all this, how will anyone deal with all that are here illegally!
The constitution gives each state the right to bring troops in, in the event of an invasion.. no state has done so!

From what I read almost all the jury were donors to the democrats, including Clinton and AOC.

I submit there are forces even greater than him which seems to be pretty much a Captain Obvious.
The prosecution never presented evidence that the thumb drives he purchased on 9/13 were the ones given to Baker. Just that he purchased some thumb drives six days before Sussmann lied to Baker during the meeting.
The prosecution’s billing witness confirmed that Sussmann billed the firm, rather than Clinton, for the taxi ride he made to the FBI meeting on 9/19. That was a bit harder for them to overcome since the assumption would have been that he would have billed Clinton or Joffe if he was going on behalf of them.
The jurors requested the taxi ride billing records during deliberation so it was evidently a key part of their decision making process.
Had Durham subpoenaed Baker’s personal cell phone records, he would have charged him for the text on 9/18 and he likely would have been convicted. Instead, he ran up against the statute of limitations.
Maybe Durham will file an appeal over the jury consisting of three Clinton donors and one AOC donor, with one of them having a daughter who is on the same team as Sussman’s daughter.

In today’s world, where the judge is a leftist, the jurors are leftist, the entire FBI and DOJ are Leftist, and the weight of the Federal Government can be brought to bear to protect their own, there is no amount of evidence, none whatsoever, that will be sufficient for a conviction of any kind of law breaking.
Obversely, in a government where where the judge is a leftist, the jurors are leftist, the entire FBI and DOJ are Leftist, and the weight of the Federal Government can be brought to bear to attempt to bring down someone perceived as an enemy of the state, there is no amount of innocence, none whatsoever, that will be sufficient for frivolous charges of any kind to be rightfully dismissed or the target (”defendant” no longer applies) because these things are political affairs, not legal affairs.
Anyone paying attention to this from instant Sussman’s name appeared knew it was one of two things:
He was going to play the role of the sacrificial lamb, get convicted, get a short sentence if any, and then work the rest of his life in jobs as a patron of the left where he would be amply rewarded for his criminality. In this event, the entire fiasco will get dropped as “resolved”, and the media will never touch it again.
Or...he was going to get off scot-free. In this case, he is acquitted, declared a hero of the Left as unjustly tried, and the trial will be paraded as an example of government overreach that is perpetrated by conservatives, and...except in that context to in which it will serve as a capstone on anything related to this sedition and criminality, declaring that the events since 2015 are proven false by a court of law, and Trump is still a criminal in waiting to be justly and rightfully tried for crimes unpunished.
Well, now we know which way it has gone.
All this “winning.”
