Pennsylvania mail ballots submitted without a date on the envelope last year should be counted, a federal appeals court said Friday, a ruling that could mean thousands more votes get counted in elections moving forward — starting with this past Tuesday’s primary.
The ruling will also almost certainly reignite the smoldering political fight over undated mail ballots; create new questions and pressure for county elections officials as they continue to count votes from this week’s primary; and create another potential opening for county-by-county legal challenges as the Senate Republican primary heads toward a likely recount.

Federal courts should NOT be involved. Elections are run by the states. What am I not understanding.
I’m curious what Alito’s opinion is in this matter.........? As I recall his previous opinion didn’t carry much weight in PA.
How does this affect FUTURE elections when it specifically itemizes a single class of votes? As I read this decision, it appears to say that, since there were misdated ballots already accepted (not being disputed), then these other misdated (undated) ballots must also be accepted. This is what 52 § 10101(a)(2)(B) forbids as unequal treatment. What I don't see, pending the formal opinion, is this treatment going forward as the date requirements from these 'new' Pennsylvania will be applied evenly, not retroactively.
As I am neither a resident of PA nor a lawyer, I can be corrected. Have at it!

Almost be better to flip a coin than vote, it might increase Republican chances.
The proof is that the ballots were received by the appropriate date. Dating the return ballot actually means nothing....totally unnecessary.

Except for a medical reason, mail-in ballots should not be allowed in Pennsylvania. If a person does not have enough desire to get to the polls, they should not be allowed to vote.
Well, I hate to say “I told you”. But, I told you so.. The next election will give that old saying, “In your face”, a whole new meaning..
Do PA election laws require a proper date on every mail-in or absentee ballot? If so the federal bench is in error.
