Senator Elizabeth Warren (D-MA) said Friday on ABC’s “The View” that interracial marriage and gay marriage are in jeopardy because Supreme Court Justice Samuel Alito‘s legal reasoning in a leaked draft opinion that would overturn Roe v. Wade.
Co-host Ana Navarro said, I’ve gotten calls from a lot of my gay friends this week who are terrified as a result of this leak because of what you just referred to as settled law, settled law, which isn’t so settled as we thought. Now, my friends on the right bring up Plessy versus Ferguson, which is the separate but equal. And they said when that got overturned, nobody had an issue. So when is settled law settled law? Should people in gay marriages be afraid? What does this mean when it comes to established law?”

Gay ‘marriage’ was part of several states’ laws before it was imposed upon the entire nation by 5 of 9 Justices. If SCOTUS were to overturn gay ‘marriage’ the law would revert back to what it was before the decision. Gays could still get married in states where it was legal, and their marriages would have to be recognized even in states where it wasn’t.
If the Supreme Court ruled we couldn’t own guns, she would fly around the room on her broom celebrating.
Yes, I’m sure Clarence Thomas is beyond anxious to make inter-racial marriages illegal.
Well, therein lies the problem of having rights “created” by five out of nine people in some faraway city.
Alternatively, when rights are created in the normal process of making law, they are far more difficult to be removed.
