JUST IN - U.S. Supreme Court has voted to strike down Roe vs. Wade, an initial draft majority opinion by Justice Alito shows.
When you read, did you confirm it was a majority opinion?
Hard to tell. It sure seemed like a majority opinion.
It starts with “Opinion of the Court.” So yes it is a draft majority opinion. Since Alito drafted it it PROBABLY means Roberts isn’t on board. He COULD be in a concurring opinion - which is concurring in the result, not the reasoning. So it could be 5-4 or 5-1-3.
Why?
Government should not be involved in decisions made by patients and doctors. Nor should tax payers be paying to kill babies
If five justices are aligned against him on the wording of a majority opinion I would think they would have the power to relegate the Chief Justice to the second-best option of submitting a concurring opinion all on his own. That is to say, Riberts would seem not to have the unilateral power he might wish to have to water down an opinion held in common by five of his colleagues, however pure his mitives might be on that score.

Public desire. That was Griswold v. CT, which was Roe’s precursor. Even though it was on the books, it wasn’t even enforced then. No state is going to ban birth control.

Oh, I agree that a leftist clerk could have leaked it, thinking they will be a “hero” of some type after being wooed by some reporter. But they do not realize they wrath they have brought down upon their heads, and on the law school they graduated from. Their law school will have no choice but to disavow them and fall on their swords and beg the justices to not strike them from the clerkship hiring list. I suspect to no avail. Their clerkship hiring program is done.
Judicial clerkship hires move on to big law firms which brings in big money, which in turn brings in big donations to law schools. The more clerkship students you have, the more big donations you can expect in the future.
This is disastrous for every law school clerkship program, especially the ones who currently have graduates at the Court. As I said, meetings will be held tomorrow morning at law schools’s to institute new training programs on the importance of confidentiality, etc. As to the law schools that currently have clerks at the Court, they are sweating bullets!

You make the pro abortion argument when discussing government involvement. If it is kicked back to the states that’s still the government.

The decision would have come right before July 4th when people aren’t paying attention to the news.
This was leaked to make it big news when people are paying attention.

Let’s assume the nuclear option here democrat-style. If this leak is real, the entire left will take the lethal step and immediately force a vote to expand the Court by say seven members, all to be picked asap by Biden and his handlers. Once that is established, the next session will see a plethora of abortion “rights” cases, all decided in favor of unlimited infanticide.
Alternative II: Congress will quickly pass a law legalizing unlimited abortion by federal statute. They will argue that returning the option to the State legislatures takes it out of the hands of the judiciary but does not preclude the Federal legislature from making its own law.
