Flashback: Justice Alito Asks Why Law-Abiding Citizens Can’t Be Armed on NYC Subways as SCOTUS Hears Major Second Amendment Case

Hearing oral arguments in a major Second Amendment case on Wednesday, Supreme Court justices considered whether to dramatically loosen gun control restrictions across the county, spiraling into a debate over whether New Yorkers should be able to carry firearms on the subway.

The case is New York State Rifle & Pistol Association v. Bruen, and it is a lawsuit brought by a pro-gun ownership group on behalf of two men denied a concealed carry license by New York State. The Empire State has a 108-year-old handgun-licensing law that allows authorities to deny a gun license to an applicant to anyone deemed to be not “of good moral character” who “lacks a history of crime or mental illness,” or in any other situation in which “good cause exists for the denial of the license.” That rather ambiguous standard, known as “proper cause,” is the same or similar to the standard many other states use in their gun licensing laws.

The groups challenging New York’s law argue that the Second Amendment guarantees both the right to “keep” firearms at home and the right to “bear” (or carry) arms outside the home. Petitioners argue that the question of Constitutional protection of gun rights outside the home is “the single most important unresolved Second Amendment question after this Court’s landmark decisions in District of Columbia v. Heller and McDonald v. City of Chicago.”

Justice Kagan asked how (plaintiff)’s suggestions would “cash out in the real world” in places like New York City subways or NYU’s campus, which is “open for anybody to walk around.”

The US Supreme Court is months, weeks or even days from ruling in a major Second Amendment case.

During oral argument, supporters of gun control brought up the specter of guns on the subway to try and convince the justices to uphold NY's gun control laws.

Now, suddenly, we have a "mass shooting" on the NYC subway.

A shooting in an area where the security cameras did not work, where the suspect's Glock "jammed," where the suspect drops a credit card receipt and...lo and behold..where the suspect just happened to be a previous subject of FBI investigation and known to them.

This smells.

Most that have a concealed carry don’t so these things. Has there ever been a case where a mass shooter had a concealed carry license..

It's true that the 2nd Amendment cannot be seen as allowing *any* type of weapon to be carried by *anyone* at *any* place.

But it surely can be seen as allowing law abiding,sane adults to carry many different kinds of weapons in most situations.

The other takeaway is that having law abiding concealed carrying passengers on the subway may have put an end to the carnage quickly. So this crime spree could be seen as a reason WHY gun licensing, (I’d rather have no license open/concealed carry, but that’s just me), in NY, and across the country, should have limited restrictions place on them.
