The homeless man who admitted to fatally shoving Michelle Go into an oncoming train at the Times Square subway station is mentally unfit to stand trial, a court official said Tuesday.
The official said in Manhattan Supreme Court that psychiatrists at Bellevue Hospital made the determination about Martial Simon after a medical evaluation.
Simon, 61, has been held at Bellevue in Manhattan since his arrest on murder charges in Go’s Jan. 9 death. He did not appear in court on Tuesday.

He shouldn’t stand trial; he should be committed to a mental institution. The individual who signed his release instead of committing him is the one who should stand trial.

You’re not as dead when a mentally unfit to stand trial person kills you. So naturally the retard shouldn’t be punished. I personally think he should be executed trial or not. He took everything that person had everything that she was and everything she’d ever be away from her. Mentally unfit or not he should die.
I believe even the insane have a sense of right and wrong. I bet if you poked him with a golf club, he would sense that he was wronged. Then he would come after you to punish you for your offense. You would be fortunate that you had the golf club.
