These people do not believe in self-government.

Rule by unelected bureaucrats is nothing new. But this college professor would prefer that to to people governing themselves through their legislatures.

As William F. Buckley once said, he would rather be governed by the first two hundred names in the Boston phone book than all the faculty at Harvard.

The writer expressed the epitome of Progressive political thought - rule by experts, because democracy is messy and you cannot “depend” on elected representatives to make the “right” choices.

They cannot stand the idea of “experts” having to make their case to Congress and Congress having to then decide to act or not and if to act then to decide how to act. That leaves the Progressives with no assurance democracy will produce the results demanded by the “experts” and if Congress won’t then to the Progressive democracy fails.

They think they are morally and intellectually superior because they don’t believe in God, but their religion is bureaucracy and their gods are professional affirmative action bureaucrats.

And to sharpen Buckley's point, the author who is a law professor and the national legal director of the ACLU has this to say in his bottom line:
"...we desperately need to respond effectively to the two greatest threats we face — the pandemic and climate change."

It’s the idea that we should be governed by laws and not by executive rules and regulations. The article mentions W.Va vs the EPA in an upcoming case over environmental regulations.

The EPA has gone bat guano crazy over the years and it seems there’s a good chance the SCOTUS is going to vastly limit the power of the EPA (and by extension, all Federal agencies). If so, it will be one of the most important rulings in the history of the Court.

It has nothing to do with the complexity of the problem. It has everything to do with the authorization that Congress has granted.

The majority of the court stopped the order, because they did not see specific authorization granting OSHA authority to mandate vaccines. They did see specific authorization for Medicare to mandate vaccines to health care workers.

The precedent set by the court whether intentional or not, is that Congress does have authority to mandate vaccines.
