The U.S. Supreme Court blocked President Joe Biden’s vaccine mandate on large private businesses through the Occupational Safety and Health Administration (OSHA) on Thursday, but upheld a Centers for Medicare & Medicaid Services (CMS) mandate.
The decision on the OSHA mandate was 6-3; the decision on the CMS mandate was 5-4, with Chief Justice John Roberts and Justice Brett Kavanaugh joining the court’s three Democratic appointees in upholding it.
As Breitbart News reported last week, the Court had appeared skeptical of the mandates during oral arguments, especially the OSHA mandate, as Solicitor General Elizabeth Prelogar struggled to identify the statutory authority for imposing it.
Chief Justice Roberts had seemed particularly irritated by a comment by MSNBC anchor Stephanie Ruhle that had been retweeted by White House Chief of Staff Ron Klain, which referred to the OSHA mandate as a “workaround.”
The conservative justices seemed concerned during oral arguments about the CMS mandate’s use of the federal spending power to pressure institutions accepting Medicare and Medicare funding to comply, but the more limited scope of the mandate, at least compared to the OSHA mandate’s more blatant intrusion into the private sector, appeared to save it.

So only federal healthcare workers are affected by the mandate. Not those who work in the private sector.
“Chief Justice John Roberts and Justice Brett Kavanaugh joining the court’s three Democratic appointees in upholding it”
SMH
CMS,
ME, TOO.
I’m pretty sure it’s all healthcare organizations that receive federal money - meaning Medicare or Medicaid. So virtually all healthcare organizations.
Yup.
If something is unconstitutional here, then it ought to be unconstitutional there as well.
So my wife who just had COVID 3 weeks ago has to get a shot now because natural immunity no longer exists in today’s world.
Does this mean that companies that work with the federal government are no longer part of the mandate?
Pretty much all hospitals, clinics, labs etc.
Will this effect those ON Medicare as well?
IOW, will we be required to take the clot shot in order to receive other Medicare benefits?
And now the backlash from the White House / Big Media cabal, desperate to keep the fear & hysteria going ...
“they are putting every American’s life in danger with this disturbing decision!” etc. etc.
blah blah blah
Here for known as the “Brandin Ruling”
Thanks wise Latina! snicker
This ruling doesn't affect federal contractors. That action was done as an executive order. I can see how an executive order could affect workers in the executive branch, but I don't understand how it could be passed down to contractors, unless there is a provision allowing such in the contract.
Well, from looking at the numbers in one story I read, there were about 101 million workers combined affected by the OSHA mandate together with the healthcare worker mandate.
The OSHA mandate, covering about 84 million workers, was struck down. The healthcare mandate, covering about 17 million worker was upheld.
Not good news for the healthcare workers, but Biden’s illegal mandate of private businesses was the centerpiece, and it went down in flames.
Not a good day for Dems:
OSHA mandate shot down
Sinema says she suppports the filibuster
Unemployemnt applications ‘unexpectedly’ take a big jump
Producer Price Index up big
Vastly more people work in the private sector than for the federal government.
Federal government workers are mostly far left activists anyway, who voted for Biden. They are going to have to suck it up.
What gives you that idea? Any facility that accepts Medicare and Medicaid is required to mandate vaccination for their workers. Whether that includes all workers or just those in contact with patients depends on how “health care worker” is defined under CMS. This is for hospital and non hospital settings.
