Exactly right. This was purely an arbitrary decision.
Knowing the Roberts Kourt I predicted awhile back that it would split the baby.
So then if the Biden administration required all companies with more than 100 employees in it's role as a regulatory authority then it would have been constitutional?
That will eventually die when they have no one willing to work in their hospitals.

My RN niece and her medical calibrator husband worked at Riverside Hospital in Kankakee, IL, and were pushed out by vaxx mandates, so they sold their house, and moved to the free state of Tennessee and are thriving again!

Except that unlike flu vaxxes, CoupFlu vaxxes are far more dangerous and do not work.
Plus, I’d argue that without an audit of every alleged CoupFlu death in the country, we don’t know for a fact how dangerous CoupFlu is for seniors. Or anyone else.
