COLUMBIA, S.C. (WBTW) — South Carolina Attorney General Alan Wilson and his counterparts from 26 other states filed an appeal with the U.S. Supreme Court Saturday morning in an effort to block the Biden administration’s OSHA vaccine mandate.
The filing, announced by Wilson’s office Saturday morning, comes after a panel of the Sixth Circuit Court of Appeals, in a split 2-1 decision, lifted a stay against the mandate Friday evening. Lifting that stay would allow the Occupational Safety and Health Administration to require people who work at companies with 100 or more employees to get vaccinated.
“The fight against the Biden mandate continues, even to filing for a stay in the early hours of this morning,” Wilson said. “The rule of law will prevail and the President’s grasp for power halted.”
A long list of companies and other organizations joined in the appeal, which was filed just before 1 a.m. Saturday, Wilson’s office said in a news release.
“This case does not present the question whether vaccines or vaccine mandates are wise or desirable,” the filing says. “Instead, it presents the narrow questions whether OSHA had authority to issue the Mandate, and whether it lawfully exercised whatever authority it had. After all, ‘our system does not permit agencies to act unlawfully,’ even during a pandemic and ‘even in pursuit of desirable ends.’”

Hopefully one state or one targeted worker files a new pleading that since omicron is scientifically confirmed to be far more contagious, every worker physically reporting to a workplace should be tested, every day, regardless of vaccination status.

This is not a law, mandates are not laws. Just tell the fake Biden administration that you will nullify any vaccine or mask mandate orders.

The USSC will not grant the stay. Oh no...it’s all over.
The full 6th circuit will throw out the mandate. Yes! But they’re going to appeal to the USSC and the USSC is no good...we’re boned!
The USSC will not hear that case on appeal and the mandate will be gone. Wow, who would have thought...

Missouri said before these lawsuits that the state has no state OSHA and that MO won’t be cooperating with fedgov on this.
If SCOTUS passes on it, red states will just legally secede further, so I think this gets a 9-0 rejection
I have no question based on all of their decisions thus far that SCOTUS will not grant the stay.
If you’re talking about the mandate (they are two different things), you’re smoking crack if you think you’re getting a 9-0 decision throwing it out. We’d be lucky to get 5-4.
But not hearing it after the 6th tosses the mandate? Well, that’s exactly the kind of gutless move that John Roberts lives to make and that is exactly what is likely to happen.
False, the two Obama judges were the ones who wote this legally incompetent decision.
Illegal exexutive action, attempted to be made paletable by a head fake on testing is still illegal.
