Just the confusion over this will create a weeks or months delay in getting any jab program going again if it happens to be reinstated. This should buy me the time I need to get to retirement without being given an ultimatum. I may have to get another batch of reserve horse paste though as what I have expires in February.

A lot of government policy is set via contracts. Minimum wages, diversity, etc.

This drops a nice little bomb into it. Previously, it was held that a contract can be anything, so the courts where very hesitant to interfere. Heck, there are NDA’s that explicitly limit you from reporting criminal offenses. When Snowden’s claims first came out, I did not hear anyone at alphabet soup saying he was wrong, but a lot of people saying he violated his contract.

I will defer to lawyers here, but this is an interesting precedent. And in my opinion a good one.

So all of those employees of contractors that were let go in October/November, can they be rehired with out loss of seniority/benefits? My son’s company lost about 20% of their engineers

I will have to ask him. He lost almost all of his engineering staff. He’s a germaphob....... so he and wifey ran out and got the jab ASAP.... it must come from his father’s side of the family.... birth defect I say.

This is a major problem right here. The control that the federal government has on the overall U.S. economy is too big. For a free society to prevail, the size of the government needs to shrink considerably.

When summer came during a pandemic during the Obama administration, the numbers went down and the Obama White House said .... stop testing. That is exactly what we should’ve done in June 2020. People went outside and the numbers went down.

Good afternoon Red. Pardon me if I’m wrong but as far as I can see... Brandon is getting smashed in the courts. He might have won an early decision or two in the lower courts but ever since then the more important courts have been striking down the mandate consistently.

Yes, but because of the somewhat counter-intuitive way court decisions work, we only have to win one case at the district court level to get a national injunction. Doesn't matter how many you lose because the result of those "losses" is just a dismissal of that particular case. There isn't any "order" saying that it must be upheld throughout the nation. And we've won.

I know how much he is hated, but the truth is that we're winning in these courts largely because The Turtle tossed the judicial filibuster, and rammed through huge numbers of Trump nominees. And, despite the predictions McConnell would fold, also kept Garland off the Supreme Court.

Credit to the Turtle where it is due on judges.

LOL!!! And I told my HR representative today who reached out to me about their mandate, prior to this ruling, that it was UNCONSTITUTIONAL and that I would not comply.

Shouldn’t be since it’s only the executive branch that he controls and he doesn’t have that kind of executive power. Judicial and Legislative branches are excluded.

He is such a braindead old fool that a story I read today stated he claims to have been an envoy for Golda Meier and Israel vs. the Egyptians during the 67 war!!! Only problem with that is, he was in law school, plagiarizing his law schoolwork and getting caught at it. He was only 25 years old at the time. He finished #76 in a class of 82 students!!!! Nothing like having such a law brain in charge of the nation. Instead, we get a Braindead old fool, who lies through his @$$ and makes up stories to make himself look smart, powerful, knowledgeable, expert in all things, ahead of all others in all things, when he is actually a lying fool back then. FWIW, I think the currrent status is ...

OSHA/ETS - Dead
Contractor mandate - Dead for now
CMS - Mixed court decisions. 11th Circuit came out yesterday and denied TRO against CMS vax mandate - see FN7 of Dec 7 Opinion in Georgia et al v. Biden contractor case.

OSHA can keep pushing. It will be putting out a final rule, not an emergency rule, in about a month.

The government is never going to relent on mandates. when told “Not this way” they just push another way.

There was a contractor vax decision last week, Kentucky v. Biden, where the geographic scope of the order was limited to a few states.

So, sometimes one win is enough to cover the US, sometimes it is not.

What category of company is it, private with 100 +, fed contractor, fed gov, or CMS-connected?
