Could Dr. Fauci be sued for coerced vaccinations? The FDA? Members of the FDA advisory committee? Certainly Pfizer?

We need lawyers willing to test these legal theories.

I keep reading where Americans are pretty much resigned to the notion that they can't sue for harm done to them by vaccines, because the United States of America itself cannot be sued. But what constitutes the United States of America? Does the F.D.A.? An advisory committee to the F.D.A.? Certainly Pfizer is not the United States of America.

If a statement is false, misleading, incomplete, lacking candor, or is in any way intellectually dishonest, and the author knows that such a statement is likely to be used by the United States of America to compel action which is harmful, can't that person liable for any harm done?

So the Emergency Use authorization shields makers of vaccines from damages caused by the vaccines... but if that Emergency Use authorization is made based on false or misleading statements, doesn't that create liability? Can't Pfizer be sued if not for the harm done directly by their product, then for the harm done by their misleading testimony which includes the harm done by the product which results from that testimony?

If a person consents to vaccination only because of coercion, can any false or misleading statement which led to that coercion create liability?

If mere legislation can absolve liability, or even moreso, empower a regulator to absolve liability, what was the point of the 11th amendment? I might argue that Congress ASSUMES liability, which it then is relieved of via the 11th amendment. Shielding laws for gun manufacturers fill the purpose of the 2nd Amendment. But if the U.S. is harmed by assuming liability through actions which deceived a regulator (the Courts could never argue that legislators were deceived into enacting a Law; that responsibility always lies with the legislators), is the U.S. itself the only possible plaintiff? Can't someone claim damages by claiming that deceiving the U.S. led to damages caused by the undue loss of a right of action?

Seriously, think about it: if you're denied justice by someone's perjury, you can seek justice from the perjurer. The crime of perjury in a criminal trial is often equivalent to the crime of the original trial.

Well, he can't be sued for medical malpractice. He's never treated a covid patient. Or any patient for anything for that matter.

That was pretty cagey of him.

Not sure if they can be sued. But if you have a bad reaction to a shot that your employer is mandating you get, your employer better lawyer up.

That is just what I was wondering about. If your boss mandates a jab that makes you sick or kills you.... He should be totally liable. I have so many friends who got the jab and still got covid, bad covid. Sick in bed, needed the antibodies infusion. I had friends who got the jab and were sick in bed for as long as three weeks, very sick, caused by the jab. And they can still get covid. I was looking forward to the covid vax. I was never anti vax until now.

I was never anti vax until now.

Same here. I was never anti-vax until one of my kids had a weird reaction to a vaccine as a toddler. Coincidentally (or not), he's also my only kid out of six with special educational needs. I still got my 10 year tetanus shot as recently as the summer of 2020, no problem.

But this garbage with the clot-shot? I'm beyond "hesitant" at this point. I don't trust these bastards anymore.

You ask some good questions. I’m not familiar with the 11th amendment. I will have to look into it.

You may want to pose your questions to Aaron Siri, who is the attorney for ICAN.

I am rather surprised that no retired paralegal or attorney who has years of experience in medical malpractice, product liability, personal injury, and/or the like has not started a blog devoted to thought experiments on how to pursue legal action on Covid issues.

Vaccine makers can be held liable for injury if willful misconduct on their part lead to injuries. However, the government must first criminally prosecute them for such before vax injured people can go after them for civil damages.
