Today they are expected to bring in a witness that will impeach Gaige Grosskreutz' testimony claiming that he did not say that he wished that he would have emptied his gun into Kyle Rittenhouse."

It should be a lively day on the stand.

I imagine that Kyle will continue to smile and look relaxed during the trial knowing that the prosecutors are total idiots, and that Judge Schroeder will continue to make humorous insertions from the bench (probably because he already knows how this trial will end with a directed verdict of innocence).

As Hawk Harrelson used to say, "Sit back, relax, and strap it down" cuz' no doubt this one is going to get jiggy.

I predict the state is going to look VERY bad if they try to attack this kid. He comes across as honest and innocent and it will blow back in their faces if they go on the attack.

Kyle said that’s why he had a strap for the rifle

I had to rush off earlier, so did not complete my post. Some comments:

Guilt or Innocence -- As I was taught: Lack of proof is not proof of innocence. With that in mind our system of Guilty/not Guilty is, IMHO, inadequate. I would favor a third option: Not Proven. That option would allow for a retrial if the prosecution fails to make it case, or additional evidence turns up later. I know, double indemnity would be a major and reasonable obstacle.

Directed Verdict -- From what I have observed and read of the case, Rittenhouse has a solid case for self-defense. But Jury's can be difficult. A directed verdict would focus all 'blame' from the far left onto one person: The Judge. It would take a very courageous judge to stand up and place that blame on himself.

The Jury -- Judges are usually very good at 'reading' a jury, thus the Judge's decision will hinge on that.

My personal prediction: Hung Jury and no retrial

If the judge dismisses the case with prejudice, it means that he cannot be tried again on the same charges. It's equivalent to a not guilty verdict. If this was a run of mill murder case, I get the impression that the judge would have dismissed it with prejudice, but because of the publicity and the high profile, probably not. I do not know if he Rittenhouse might not be technically guilty of a weapons charge, but it seems abundantly clear that Grosskreutz is guilty of assault and of weapons charges.

The weapons charge is cared for with Kyle’s testimony. He left the weapon at his father’s house who lives in Kenosha.

It might not work in Chicago or New York, but in Kenosha . . .

Folks in Kenosha are general, run of the mill, normal people. They are not accustomed to seeing 10-years-old with a murder sheet as long as Grosskreutz’ arm.

Yes, but Kyle is doing very, very good and maybe it have rocked the prosecution. They’ll get a chance to regroup over lunch, tho.

My best advice to Kyle during cross is: “just tell the truth, talk to the jury, and keep your cool when they attempt the big GOTCHA!”

Atty Branca’s live comments;

Judge Schroeder instructing Kyle on risks of testifying, has right, State can cross-examine, etc. Any criminal history (none of that). Could be asked about other crimes, wrongs, prior events.

Judge Schroeder: Have right to not testify, wouldn’t be commented on.

Judge: Discussed with lawyers, think about what you are doing, think it’s the best thing, threatened or pressured, promised you anything, is your mind clear today, feeling OK, had anything alcoholic, drugs?

Kyle: No to all.

Richards: Consistent with advice of counsel.
