JUST IN - 5th Circuit panel believes the OSHA vaccine mandate has "grave statutory and constitutional issues". Biden admin ordered to respond by 11-8-21.
Federal Court of Appeals just issued a temporary halt to Biden’s vaccine mandate, Texas Governor Abbott announces.
No..it would appear that what this will do is come to civil law suits by workers who are forced vaccinated by their employers.
This goes down, those work places would be found to have violated civil rights under the constitution if the ruling goes against the demented dictators rule.
IMO.
BTW, lawyers are licking their chops.

FDA then. The point I’m not making well is that the courts are going to hang hat on “OSHA is not competent in this field, or not empowered in this field” rationale.
Courts will likely tell the government how or what to pass, that will be okay with the courts. A SCOTUS decisoipn (the Keith case) suggested a FISA court, for example.
Federal Courts want a big and robust federal government too. What’s the point in being a big fish in a small pond?
At least TX, LA and MS have a respite from the mandate for now.

I didn’t write “good money” - I wrote “real money”
And the comment was clear - that if any one thinks the issue is not ripe for litigation until January 4, they are IGNORING the costs that businesses will need to absorb before that date.
But no matter - TexasGurl24 clarified that once the ETS is published in the Federal Register, that the ETS is ripe for litigation.

It would seem so. He is in the 5th Circuit jurisdiction, as is his company (I hope!), and the court has STAYED the mandate pending further judicial review.

Most people do not know that the CDC is not part of the US Federal government. I told this to the “health officer” at my company (a real ‘hall monitor’ if there ever was one), and said nothing. Yeah, take that, buddy.
