Prosecution Tips Hand, Plans to Depict Kyle Rittenhouse Attacker as 'Hero.' That Turns Out to Be a Problem.

Prosecutors arguing to put Kyle Rittenhouse in prison for the rest of his life tipped their hand on how they plan to do that in the fourth day of testimony on Friday. Questions abound, however, about its relevance and admissibility in court.

Rittenhouse could spend life in prison for killing two men, Joseph Rosenbaum and Anthony Huber, and wounding a third, Gaige Grosskreutz, during the Kenosha, Wisconsin riots on August 25, 2020. Rittenhouse claims self-defense in all three shootings, parts of which were recorded or live-streamed. Prosecutors even shared clips from FBI surveillance recordings from a fixed wing spy plane flying above the melee.

The city core erupted into flames as BLM and Antifa, some of whom came from the all over the country, created chaos in Kenosha after the shooting of Jacob Blake.

Among those answering the call to protect businesses, specifically Car Source car lots, was Kyle Rittenhouse (pictured below along with two of his friends and several others). Rittenhouse, a life guard with some medical training, came to help give first aid to anyone who needed it.

During the testimony of Anthony Huber’s great-aunt, Susan Hughes, the prosecution attempted to have her tell a story about a time when Huber “ran into danger.” Rittenhouse attorneys objected that the story was inadmissible because of a rule about habit and custom evidence. The jury was abruptly sent out after prosecutors complained about the judge sustaining the objection.

In arguments over the issue, Assistant District Attorney Jim Kraus gave away the prosecution’s play book. It’s a narrative that has little to do with the law and plenty to do with woke politics, P.R. and the erosion of self-defense.

Kraus argued that he wanted the aunt to tell a story about Huber’s attempt to “save” his family from an impending explosion. He said it should be allowed because the prosecution intended to weave a narrative about Huber’s heroism the night of the shootings. Indeed, Kraus said he planned to tell the jury that Huber was a “hero” for attacking Rittenhouse because of his possible belief that Rittenhouse was an active shooter. No one knows, nor has evidence been put forward, about Huber’s motive for attacking Rittenhouse. The prosecution will argue that Huber was provoked to beat Rittenhouse with his skateboard because of the first shooting of Joseph Rosenbaum.

This is a political trial. It depends on which side Rittenhouse is on. He’s on the wrong side. I knew the left wanted him dead the moment I saw that social media was rejecting postings that praised him.

The left organized, implemented, promoted and aided the BLM riots last year. No BLMer was prosecuted.

Kyle Rittenhouse is on the right side. The left wants him dead. Besides he’s White.

I suppose that Rittenhouse should have mused about and somehow evaluated the motive behind Huber’s attempt to kill him with a skateboard?

Outrageous nonsense!

If My right to self defense depends on the motives of my attacker then I have no right to self defense.

The end game is officially protected violence against the enemies of the Left. That's what this is about, that's what the systematic corruption of the justice system is about.

Third, the defense also notes, if Judge Schroeder decides to admit this “child Huber saved family from explosion” evidence, then the defense wanted the opportunity to share with the jury its own rebuttal evidence.

Specifically, the defense had in its possession several criminal complaints against the then-living Huber in which he’d been credibly accused of far from peaceful conduct. In one complaint he’d been charged with holding a large knife to the throat of his brother, and later also holding the knife to his brother’s stomach and threatening to “gut him like a pig,” for failing to clean his room. There was also a complaint in which he’d taken a plea to a charge of strangling. In another instance, he had threatened to burn down his home “with all you f’ers inside it!”

Ultimately, that’s the deal Judge Schroeder offered the State. If they wanted to have their witness Ms. Hughes testify about the “child Huber saved family from explosion” incident, he’d allow it—but then he’d also allow the defense to bring into evidence Huber’s more violent documented conduct, to rebut the State.

Faced with that price, the State decided to withdraw its questioning of Ms. Hughes about the heroically prevented explosion.

Agreed but I might add

If My right to self defense depends on me psychoanalyzing my attacker before i decide that its OK to for me to legally defend myself, as they are attempting to beat me to death, or they are pointing a gun at me, then I have no right to self defense.

Pretty stupid prosecution strategy. Trying to make this guy out a hero. Huber, Rosenbaum and Grosskuertz were present those nights with the intent to Burn, Loot and Murder, while Rittenhaus was there to protect property and businesses from the mob, and to offer EMS when he could. He was part of a group of guys with like intent, while the other three were part of the mob. The idea that Rittenhaus intentionally murdered a “hero” is absurd. If I were on the jury that is how I would view it. I would also be disgusted by the mentality that would expect me to buy that line.

If you have the time - I highly recommend following Legal Insurrection's coverage which features Andrew Branca - a leading expert on the law of self-defense. He is doing a blow-by-blow analysis of everything happening in this trial. As a lawyer, I find his coverage excellent, and I think it would be at least as interesting to the lay audience.

As a juror I would be a little peeved that a prosecutor was trying to get in irrelevant and inadmissable evidence that I had heard would make a rioter out to be a hero.

If that is the crux of the prosecutor's case he should be jailed for being a ass.

Just read the Day 4 summary and it is excellent. Lengthy but clear and detailed.

The way I see the vid - when Huber attacked KR it was in fact Huber who killed himself, when - in an attempt to take the rifle away from KR (whose finger was (most likely) on the trigger) - he yanked the barrel into his chest, discharging the round into his chest.

Rule #4: know your target.

If you’re going to kill someone (say, beating grounded target with heavy skateboard) in belief he’s a fleeing felon, you’d better be right. Huber wasn’t. He had no direct information about Rittenhouse, only hearsay from an angry mob. Huber also forgot that the target also has a right to self-defense; Rittenhouse was clearly armed and willing to fight. Hubert may have meant well, but died for his mistake.

And Huber’s intent is irrelevant. Huber’s alleged lack of mens rea (guilty mind) doesn’t change Rittenhouse‘s intent nor guilt. Huber is not on trial.

Anthony Huber pulled the barrel of Kyle’s AR-15 towards his chest, Kyle had his finger on the trigger, and BAM, shot right through the heart. Dead never to skate again. And the liberal world weeps crocodile tears.

I know these prosecutors are woke, but they are experienced trial lawyers. My interpretation is they know they are losing this case and tried a desperation strategy they knew probably wouldn’t work but it was basically their only chance.
