The Supreme Court's questioning during oral arguments in a New York gun rights case showed that several justices have strong reservations about the state’s highly restrictive regulations for getting concealed carry permits.
The case, New York State Rifle & Pistol Association, Inc. v. Bruen, is potentially the biggest gun rights case to go before the high court in more than a decade.
New York Solicitor General Barbara Underwood noted that, under current rules, the state has the discretion to evaluate a person’s reason for applying for a permit, as an applicant has to show "proper cause" for needing one. Underwood pointed out that the more specific a reason a person gives in terms of facing a threat of danger, the better their chances.
"Why isn’t it good enough to say I live in a violent area and I want to defend myself?" Justice Brett Kavanaugh asked.

Breyer, Kagan and Sotomayor are rabidly anti-2nd.
Roberts and Barrett asked some good questions, but they also asked more than one question about "sensitive places."
I am confident that we have at least 5, probably 6.
I do think that there may be some language included in the final opinion that might be problematic in regards to "sensitive places."
We might get something like nationwide Shall Issue, but with certain places being ok for States to make off limits. Something akin to how North Carolina was in the early 2000s.
Big improvement for NY, MD, RI, NJ, HI and CA, but not likely to have much impact anywhere else.
but how about the unconstitutional “Safe Act”? Not sure why that hasn’t made it to the SC-
It’s a tax! < /Roberts >
That’s not at issue in this case.
It's being treated as if it were a privilege and the government has the ability to determine if you deserve to be eligible.
- I live in NYC and want a gun permit.
- Why ?
-Have you been down in the subway recently ?
Yes, the oral arguments were highly encouraging. I’m not as concerned about the “sensitive places” issue. This will shake out on a case-by-case basis. Thanks for posting.

Simple: If NY can limit possession of a category based on cause, they can declare some categories have no cause.
Remember: NY has a unified own/carry pistol permit. If you don’t give “just cause” to carry, you’re subject to denial to own. Applying same logic to “assault weapons”, NY effectively denies all reasons to own/carry and so permits none.
Have to win this case before attacking SAFE law.
Never interpret SCOTUS’ comments at oral arguments. A fun exercise, yes, but is not a reliable indicator.
Usually a hacksaw will cut that chain around your ankle.
You are correct. You can’t read too much into the questioning, but I am feeling ok rather than a complete sense of dread.
These states will be flipped to "shall issue" but will most likely still refuse to recognize permits from other states.
If she wants to protect the little children she needs to have a gun ready to protect them in a home/away crisis. The job of parents is to protect their children and we can’t if we are handcuffed by anti liberty laws.
My concern is that Roberts votes with us, and thus he writes the opinion in such a way that waters down the win. I’d much rather have him vote with the left, and get a strong, clear opinion written by Thomas or Gorsuch.
Not sure about that. The general course of action is get your permit, which is granted for target and hunting (restricted concealed carry) and that's the only time you can transport. After 1 year, based on the county you can apply for unrestricted concealed carry. Some places are difficult, some are easy, some require a field course etc.
Agreed! You have the three communists on the court and then you have the pure Republican Party backed squishes Roberts, Kavanaugh and Barrett all of which can and will take a whiz on the Constitution like the three commies at their whims.
