EUGENE, Ore. -- A man who shot and killed someone who was breaking into his home will not face charges, police say.
The shooting happened at South Crest Apartments on Donald Street early Monday morning and it left Skyler Weisberg, 28, dead.
Leading up to the incident, police said Weisberg left his home in Tillamook County sometime after 10 p.m. on Sunday. Authorities pulled him over in Polk County after he made an alleged minor traffic violation, and he told the deputy he was headed to Eugene to look for his wife.
Just after 3:30 a.m., Weisberg arrived to the apartment he had lived at with his wife on Donald Street and pounded on the door, waking up the new residents of the home, a man and his girlfriend. Police said Weisberg demanded to see his wife and continued pounding on the door and window. Multiple residents at the complex called 911 to report the disturbance.
Despite the resident telling Weisberg his wife wasn’t at the location, he broke the window to get inside, police said. The resident, who was armed with a gun, kept telling the man to leave.
That’s when police said Weisberg moved toward the resident, reportedly making comments about death, and the resident shot the home invader twice. However, the man soon continued coming closer again. A third shot caused Weisberg to fall to the ground.
Police said the man and his girlfriend followed instructions from dispatch and the officers who arrived at the scene and were removed from the apartment. Medical aid was unable to revive Weisberg and he was pronounced dead.
Weisberg’s family has been contacted. Police say he had a history of mental illness and at least one prior psychotic episode.
The decision to not file criminal charges was made after consulting the Lane County District Attorney’s Office. We are withholding the name of the resident at this time as he is not facing charges in the incident.

There are probably many different ways it could have been handled such as the legal occupants leaving the premises if possible and as you suggested locking themselves in the bathroom.
But when a seemingly and now verifiable crazy person is actually closing on you after threatening to kill you there is not much time for consideration of alternatives.
If it were me I would have done what the occupant did.

Eugene is a college town many of the apartments cater to the student meaning the unit probably is a studio, retreat where?
Retreat in your home at 3:30 AM to wait for the police is a or could be a fatal mistake for the innocent person.
This man did the right thing. The fact that Eugene authorities (a deep blue city) agrees says a lot about the situation.
When the police are removed from society, all crimes carry the death penalty. Expect to see more of this, especially in areas that have experienced riots and other crimes with no consequences.

Skyler seemed pretty determined considering the first 2 shots didn’t convince him to go away. I would suggest that the homeowner consider buying premium ammunition or spend more time at the range.

Per the article the apartment dweller fired two rounds and stopped. The third round was fired when the soon to be dead idiot kept advancing. I would have emptied the magazine (or cylinder if a revolver) and quickly reloaded.

Here’s a fun fact that’ll make you go hmmm. Everyone knows that the state of Washington is about as blue as you can get. We’ve been called the Soviet of Washington since the 1940’s.
However this state has about 7.5 million people and we have over 600,000 active CCW holders growing daily. We have more CCW permit holders than any other west coast state. And back in the ‘90’s Washington State had the most NRA members of any west coast state. Talk about cognitive dissonance!

Pretty much impossible to have someone hospitalized for mental problems these days. The bleeding heart liberals got the mental institutions closed so now WE have clean up the mess.
Mental illness is a way overused excuse for people who just choose to do evil things or make bad choices.
