AUSTIN, Texas — In a dive into new political and legal water, Texas Governor Greg Abbott has initiated the first-ever border security operations in which thousands of National Guard troops — newly imbued with civilian arrest authority and given 40 hours of traditional police training in the use of deadly force — have started handcuffing illegally entering migrants on state trespassing charges.

Perhaps I am cynical, but Governor Abbott is facing a challenge from the right. His inclinations are moderate, similar to Bush and Perry, but in an era of increased conservative militancy, pursuit of moderation would lead to his defeat in next year’s primary. Abbott also knows that DeSantis’ stock has risen to the Florida governor’s resistance to Washington while Noem’s stock crashed after waffling on transgender issues.

and what are they doing with them after arrest??? In Hungary and Poland illegals are arrested, booked with photos and then put back on the other side of their border fence. I like that!

PS - the EU in unhappy about about how they handle the illegals.

If the Governor isn’t prepared to tell any judge to go to hell then he shouldn’t have wasted everyone’s time by starting this up in the first place.

The National Guard should guard the country.

The National Guard belong to individual states. When the the Fed activates them for Federal service, Governors must sign off on it. There has been a lot of controversy over what happens if the Governor does NOT authorize transfer to Federal government service ( active Army). This grey area should be tested.

I am in error with current regulations.
“ State Mission
When Army National Guard units are not under federal control, the governor is the commander-in-chief of his or her respective state, territory (Guam, Virgin Islands), or commonwealth (Puerto Rico). The President of the United States commands the District of Columbia National Guard, though this command is routinely delegated to the Commanding General of the DC National Guard. Each of the 54 National Guard organizations is supervised by the Adjutant General of the state or territory who also serves as the Director or Commanding General of the state military forces (in DC, only the Commanding General title is used).
When serving under Title 32 Active Duty, Title 32 service is primarily state active duty. This includes the following forms of active service:
o State Active Duty (SAD). The Governor can activate National Guard personnel to “State Active Duty” in response to natural or man-made disasters or Homeland Defense missions. State Active Duty is based on State statute and policy as well as State funds, and the Soldiers and Airmen remain under the command and control of the Governor. A key aspect of this duty status is that the Posse Comitatus Act (PCA) does not apply.
o Title 32 Full-Time National Guard Duty. “Full-time National Guard duty” means training or other duty, other than inactive duty, performed by a member of the National Guard. Title 32 allows the Governor, with the approval of the President or the Secretary of Defense, to order a member to duty …”

However, these laws have never been tested, it is plausible that a Governor would refuse his Guard members to be activated for Federal service. Now would be a good time to test it.

I applaud any use of NG soldiers to protect our borders. My second comment is on the use of the word, “Migrant.” Migrant implies someone who travels sporadically/seasonally - a nomadic existence - even returning from whence they came. These invaders have no intention of leaving here. They are still “illegal aliens.”

“Texas DPS Director Steven McCraw confirmed to the Center for Immigration Studies that the first of some 3,000 policing-trained National Guard soldiers to be deployed over the next six weeks have begun filling gaps in the line, making arrests and turning their detainees over to DPS officers who will do the investigation and charging.

“Nobody’s ever really used the guard before in this capacity,” McCraw said. “We’re going to use them to actually secure the border. The governor, the legislature, and the citizens of Texas have made it very clear; they want the border secure. It is good for our federal partner as well. The federal government should be thanking the state of Texas, and it’ll make the rest of the country safer as we increase the level of security.”

that’s strange. I’ve watched a whole lot of footage and such of illegals being rounded up and shame walked, but handcuffs? definitely a lack of those.

(with the exception of certain morons who forgot that in the illegal immigration game of chutes and ladders, it’s fair play to get sent back to the starting square.)

An invasion is an invasion, it doesn’t matter who’s doing it or why. NG assets doing this job IS within the bounds of The Constitution.

Authorize the use of deadly force.

That is the only sensible way to deal with an invasion.


My solution was always simple and cheap.

Raised towers every 500 yards along the border. All connected by technology. A spotter and sniper in each with night vision equipment.

Simple orders of “shoot to kill”.

It would have stopped in less than a week.
