Justice Sonia Sotomayor: 'There is going to be a lot of disappointment in the law, a huge amount'

Days before the start of a tumultuous term, and after the Supreme Court justices divided bitterly over a Texas law that bars most abortions after six weeks, Justice Sonia Sotomayor warned an audience of law students about the frustration of having to write dissents.

"There is going to be a lot of disappointment in the law, a huge amount," she said Wednesday at an event hosted by the American Bar Association. "Look at me, look at my dissents."....

"The Court's order is stunning," Sotomayor wrote at the time. "Presented with an application to join a flagrantly unconstitutional law engineered to prohibit women from exercising their constitutional rights and evade judicial scrutiny, a majority of the Justices have opted to bury their heads in the sand."

Sotomayor added: "The Court should not be so content to ignore its constitutional obligations to protect not only the rights of women, but also the sanctity of its precedents and of the rule of law," she concluded.

Please, Trump would still be president if his supreme court nominees read at a 4th grade level.

I’m fairly certain the vaccine mandates will end up on the courts desk at some point in the near future also and they’ll disappoint again. I very much hope I’m wrong.

IMHO using case law is what chips away at the Constitution. The foremost point of every SCOTUS opinion needs to cite the Constitution.

The Supreme Court, which started in 1789 with very little power, has amassed a great deal of power by making all of its decisions Talmud to the Torah of the Constitution.

It is as if every single Court decision has equal force and authority as an amendment passed by 2/3 of both Houses and ratified by 3/4 of the States.

Now, since our system is coming to an end, and how we are ruled will soon be simply decided by force, this observation probably doesn't matter much.

Eventually, prophets give way to judges, and then judges, as they must, yield to kings.

There is nothing new under the sun.

Why should the innocent party in a rape pay the death penalty? And the psychological damage to a woman from killing an innocent life only adds to the trauma of the rape. Abortion is not the easy answer to the vanishingly rare number of pregnancies that occur due to rape.

You are the problem

While I agree with you, I am trying to use incrementalism instead of losing because we do not get everything we want at one time.

I am fine with exceptions for rape and incest so we can ban abortion as birth control. I am fine with that because rape and incest are infintessimal and we move the goal posts by not defiantly standing on that.

It is great to have principles, but one must know how to win the battles along the way.

Someone please tell Justice Sotomayor that the SC only interprets law - they don’t make it. And would this SC please start referring their decisions to the Constitution for all of us to read and see for ourselves.

Ludicrous to say our founding fathers wrote murder of unborn children into the Constitution. Only a depraved person could imagine such a thing.

IIRC at the beginning of the right to an abortion campaign, the understanding was that it would be quickly sought. People against argued about late term being a possibility and proponents said no. It was considered an “oops” sort of option.

Now you can kill a living baby after a botched abortion. If that had been argued back in the 70’s, there would have been no Roe v. Wade because even pro abortion advocates wouldn’t have wanted that.

You’ve come a long way baby.
