The Left shouts 'vigilantes'!

The Lone Star State conjures images of the Old West, such as rugged individualism and frontier justice. So, it’s not surprising the opponents to Texas’ new pro-life law, the Texas Heartbeat Act, characterize the statute as an example of vigilantism. Like bounty hunters, the law permits any Texan to earn at least $10,000 and court costs by successfully suing any person or organization that provides or assists an abortion after the detection of “cardiac motion” by ultrasound examination. A fetal heartbeat is usually detected around the sixth week of pregnancy. Private citizens growing rich by snitching? This is outrageous! Un-American! Unconstitutional! Or is it?

But how would they know if a machine detected a baby’s heartbeat? This is the part I don’t understand.

The courts WILL intervene.

It probably won’t even pass state court muster.

In every other statute supporting tort law, a person must show they have been harmed before a suit can proceed.

But this law does not.

“Vigilantism” has very little to do with “bounty hunting” with the exception of the negative connotation attached to both of them. I don’t believe there is any law that permits “vigilantism” which takes place when laws are not enforced.

That is the sketchy part. If the abortion clinic is required to perform an ultrasound, they can do it so poorly that you can’t detect the heartbeat of a full term baby, much less a 6 week term baby. They could simply declare that they didn’t detect a heart beat.

The left shouting vigilantes is just projection. Vigilantism is a SOP of the radical left. Say something they do not like and they will destroy you. Go against their sacrifice to their god by abortion and expect to get nuked.

"Successfully" being the operative word. I don't imagine that many of those who file suit will be able to show standing so their cases will be tossed rather quickly. And since Texas is a "loser pays" state they may well find themselves without the $10,000 bounty and with the defendants legal bill.

The article is wrong. Standing to sue has been an established principle for centuries. If the plaintiff cannot show he suffered an accual, concrete injury from the actions of the defendant then the case will be dismissed. And Texas is also a "loser pays" state, too.

Texas won't even require companies use E-Verify. They're not going to interfere with hiring illegal aliens.
