Active Duty, Retired Naval Intelligence Members Told They Cannot ‘Disrespect’ Biden Over Afghanistan Debacle

Top leadership at the Office of Naval Intelligence (ONI) informed active duty and retired service members that they cannot condemn President Joe Biden amid the chaotic — and now deadly — pullout of American troops from Afghanistan. 

In an email from the ONI’s Chief of Staff, ONI members were reminded that per a Uniform Code of Military Justice and Department of Defense Directive clause they cannot disrespect senior government leadership. This includes the President, Vice President, Congress, the Secretary of Defense, and more. 

 
 

The email reads: 

Given the heightened political and social atmosphere surrounding Afghanistan, it is important to remind our uniformed personnel (active duty and reservists on temporary active duty) and military retirees of their responsibilities and obligations under Article 88 of the Uniform Code of Military Justice and Department of Defense Directive 1344.10. While it is vital to protect the constitutional right of freedom of expression for these groups, consistent with mission accomplishment, national security, and good order and discipline, it’s important to remember certain limitations. Namely, uniformed personnel and military retirees are prohibited from disrespecting senior government leadership (e.g. the President, Vice President, Congress, Secretary of Defense, Service Secretaries, etc.).

Per the same uniformed personnel policy, ONI members cannot participate in partisan political activity or distribute partisan political literature. An internal ONI member told The Daily Wire that these policies were more relaxed under the Trump administration and recalled retired officers condemning the former President.

I volunteered in 1967 to serve my country in the United States Navy. I had no idea what Uncle Sam would ask of me going in, but I was ‘paying it forward’ for the freedom Americans are supposed to have.

I watched “Freedom of Speech” get abused by hippies, red diaper doper babies, black panthers and flag burners. I NEVER ONCE challenged their right to offend me and my shipmates with their words and actions - no matter how misguided.

Now you’re telling me that people who have given big chunks of their lives and even their bodies don’t have a right to call out feckless leaders in this country???

Beam us ALL up, Lord. There’s no intelligent life down here any more!

+Retired with less than 30 years you are subject to recall and are subject to the UCMJ, but I am not sure to what degree a non-uniformed member is liable under the UCMJ as I am not a JAG OFF, (pun intended). It is very questionable that they could get away with recalling someone to punish them over a freedom of speech issue.

After 30 years you are no longer eligible for recall and are transferred to the retired list. At that point you are no longer subject to the UCMJ. So it is somewhat of a hollow threat. Most Generals have served 30 years prior to retirement. Less senior officers and the majority of enlisted do not make it to 30 prior to retirement. Flynn and others have nothing to fear.

I knew of a situation where a retiree had a FUBO sticker on his car. They tried to deny him access to the base. He sued, they lost. So I am not sure this is nothing more then an idle threat.

IIRC, Thoroughly Mobhead Milley did a pretty lowdown job of dissing Trump when he was president, down to lying about police clearing the area of protestors for the sake of a photo-op.

No disciplinary action.

Re UCMJ and retired people. As I recall, retired people with special skills can be called back to active duty with certain conditions (such as a 9/11 Event). You retirees with Intel and electronics skills might be able to further comment on what I remembered.

As I have written many times over the past years here at FR, the Navy was the most “PC”, now “woke” military department we have.

Also, remember, Adm. Kirby has been a spokesman for Biden and I’m sure also for Obama. He impressed me as a “dandy” and “quish”. Don’t know his military service but I wouldn’t want to serve under him, though Kamala Harris might be up to it as she has spent her political servicing political people by being under them.

I ran into an Army ahole in NAM re getting press credentials for a group of students I was with for their own safety. (I had MACV-credentials which I left with this Ahole and got SVN credentials instead).

There are always some senior officers who just “don’t get” reality and kiss so much Brass Ass that they often buy out whole drug stores supplies of Vaseline and Lip Balm.

Fortunately for the Free World, my late father-in-law was NOT one of those aholes. His exploits in the Cold War are still highly classified but he bucked no incompetence. I guess 3 WW2 Purple Hearts including at least one from IWO), taught him that you needed great leaders in combat/potential combat environments, not some asskissing desk jockeys whose best days were years or even decades ago.

MM, Bao Chi, SVN/Cambodia, Fall 1970, son of a WW2 CWO/CWS, son-in-law of the aforementioned 75th JASCO Signal Corps combat vet, father of one of the first American soldiers into Iraq (OIF) and father-in-law of a Marine combat vet of Kosovo and Desert Storm.

A neighbor has a sign on his lawn (he is a nice liberal clergyman), that says “Hate Has no Place Here”.

I want to put up a sign that says “Incompetence Never Has a Place Here”.

There are many here who have their “hair up” about this article.

It should be noted that there are different classes of retired military, three groups in fact.

(1) Those who served honorably and then got out (ETS).

(2) Veterans who actually deployed to a fight, got out and are now subject to the VA.

(3) Those who are actually on the “Retired List” and draw a pension.

Many here are members of two or all three of these groups. The article is referring to the third group. Members on the Retired List are under orders. They carry an I.D. card, they receive pay. They are indeed as pointed out in the article subject to the UCMJ. As such they are subject to many of the same restrictions active duty military follow.

Ever go to a veterans event? See all the guys wearing field dress, or parts thereof? As Veterans they are permitted to do that. They enjoy the same freedoms really as any other citizen.
Folks on the Retired List cannot. By regulation members on the retired list are restricted to Class-A uniforms or above. In case of the Army, in place of the unit patch on the left shoulder they must wear an “Army Retired” patch. No other unit insignia save the Regimental Affiliation crest can be worn. No Presidential Citation awards can be worn. No other unit crest can be worn. Veterans can wear pretty much anything they want.

Bottom line, you give up some things to be on the payroll. If that is too much to bear, get off the payroll.

Only applies to Commissioned Officers as far as retirees goes. NCO/Enlisted have no such restrictions.

This notes “Article 88 of the Uniform Code of Military Justice and Department of Defense Directive 1344.10.”

I suspect this has a lot more to do with the “Department of Defense Directive 1344.10” than with Article 88.
