The “judge” in some of these positions in Texas is an elected position comparable to a county administrator or commissioner in other states. It’s not a judge on a court bench.
County judges in Texas are the bosses over concerns like this. Like a small town sheriff, or the president of an HOA - they are on a power mad ego trip.
He isn’t a judge, just a administrator.
The position comes with the title.
In Texas, county judge is an executive position.
In Texas a “county judge” is the chief executive of the county.
Over the past four months I know of five acquaintances, all of whom were fanatical mask-wearers, who have contracted serious cases of pneumonia.

Exactly. The laws of the various states give this authority to various entities—governors, mayors, health departments and the like. Never heard of it being left to a judge; most are attorneys, not epidemiologists.
