Ohio Judge Orders Man to Obtain COVID-19 Vaccine

On Wednesday, an Ohio judge ordered a man to get the COVID-19 vaccine as a condition of his probation.
During the sentencing hearing for 21-year-old Brandon Rutherford, Hamilton County Common Pleas Court Judge Christopher Wagner ordered Rutherford to provide proof of getting the COVID-19 vaccine as a condition of his Community Control following his recent drug conviction.
According to Cincinnati-based station WCPO, Rutherford appeared at his hearing wearing a face mask due to the COVID-19 numbers climbing. Wagner then asked him if he was vaccinated and planned on getting vaccinated. Rutherford answered no to both questions.
As a result, Wagner ordered Rutherford to get vaccinated as part of his probation. He has 60 days to get the vaccine.
“I don’t plan on getting it. I don’t want it. So, for him to tell me that I have to get it in order for me to not violate my probation is crazy cause I’m just trying to do what I can to get off this as quickly as possible, like finding a job and everything else. But, that little thing can set me back,” Rutherford told WCPO.

Well, as a punishment, judge could impose all kind of penalties!
Now, the defendant can claim 8th amendment protections.
It all boils down, if vaccination is cruel and unusual punishment.

Yes, pro-vaxxers are fencing us in. But will that not put pro-vaxxers on the same side of the fence as murderers, rapists, pedophiles, drug lords, bank robbers etc. when the Lord returns?

His campaign site shows he’s married with childern but that doesn’t mean he’s not. I know a few gay men and they have said that some married men are the worst. This guy just has that look.

That's the thing about probation (or "community control") in Ohio. The community absolutely controls you. You can "violate" for having an empty beer can in your trash on the curb. They can search your house and the property of anybody living with you at will. They can drug test you every day if they want. They can force you to get a job and tell you what kind of job it needs to be. They OWN your butt.
I would absolutely bet that close to half of the prison population in Ohio is comprised of probation violators. A vast majority of whom have failed a random drug test.
People tend to think that probation is just "keep your nose clean for a year or two and you'll be good". Community control means exactly what those words say. You are controlled by the community. Your probation officer has direct control over any aspect of your life he chooses.
The only alternative I see is to elect to serve jail time INSTEAD of probation. I knew an alcoholic who loved booze so much that he decided to go back to jail and serve out a full prison sentence so that once released he would NOT be subject to community control. I think, regarding addicts, that this choice is made more often then we might expect.
I absolutely hate the fact that they can order somebody to get a vax as a term of probation. But I don't think he has any real legal recourse other than to elect to go back to jail.
