Employers must document the vaccination status of employees under revised CAL/OSHA rules

On top of dropping masks, a California safety board says employers are now required to document which employees are vaccinated.

In a 5-1 vote, the California Occupational Safety and Health Standards Board (OSHA) approved a clearer set of rules for vaccinated people in the workplace on Thursday.

Still, there is confusion on whether or not an employer can ask for an employee's vaccination status.

The short answer: yes.

CAL/OSHA rules

On top of dropping masks, a California safety board says employers are now required to document which employees are vaccinated.

In a 5-1 vote, the California Occupational Safety and Health Standards Board (OSHA) approved a clearer set of rules for vaccinated people in the workplace on Thursday.

Still, there is confusion on whether or not an employer can ask for an employee's vaccination status.

The short answer: yes.

“Not only will employers be allowed to ask for the vaccination status of their employees, but they will also be required to,” employment attorney Kathy Eppright said. "It's permissible for an employer if they wanted to ask that information of employees or customers in order to determine what rules to apply."

Eppright, who gave her perspective minutes before CAL/OSHA approved the revised rules, said asking for this info is not a violation of HIPAA laws in most cases.

“Restaurants, [law] offices like ours, we’re not covered by HIPAA which means you are not restricted by HIPAA from asking for medical information of this type,” Eppright added. "Right now, the agencies are making some sort of distinction between what a company can and can't do based on if someone is vaccinated or unvaccinated which is what justifies an employer asking for vaccination information.

Rules are not laws. Nobody elected these people. They are not our representatives*.

* My comment assumes I live in California, but actually I don’t. And this is yet another reason why that was a wise decision.

If you are a HIPAA covered entity then you are not allowed to demand health care information from your employees. HIPAA has no exemptions for managers or HR especially at a hospital or health care provider.

HIPAA is irrelevant. Always has been. It really shouldn’t be invoked in this debate.

This needs to be fought with other means that actually matter.

Invoking HIPPA has numerous problems.

I’ve documented them many times.

There is no private right of action under HIPAA, so you can’t sue anyone, even a covered entity, that violates it. Your sole course of action is a complaint to HHS. LOL!

There is also a massive “public health exception” in HIPAA that you can drive a truck through.

They are required to ask.
They can require me to answer as a condition of continued employment.

How will they know if I lie? Will they call my doctor and demand access to my records?

I cannot see how a lie could be discovered here.

They won’t. The regulations don’t dictate how employers are to “document.” It can range from you signing a form, making a copy of the Card (which can be easily faked) or simply looking at a card and saying that they saw it.

Our judicial system is based on the prosecution proving guilt, not the defendant proving innocence. The same principal must apply here. It’s not up to me to prove my status, it’s up to the employer.

Employers must provide workers who are not fully vaccinated with respirators for voluntary use, upon request and at no cost;

That right there requires the employer to have the employee pass an actual medical physical and fit test! Any employee wanting to wear an N-95 mask/respirator must be in compliance with the state and federal guidelines. What a nightmare!

Yep

Easily faked?

Kind of like those “ID” cards and other docs our border-crossing guest workers use to get jobs in Cali.

Or maybe something like your Voter ID/Voter Registration used in the last election/coup

So, in Minecraft, the cards are 3.1x4.1 inches. If I were going to make a card (in minecraft) the rumor is that 80lb, 216 gsm, 8.5 x 11 card stock” in “accent opaque white”, feeds though printers and looks close to the paper used. Of course all of this is in minecraft, because one could NEVER, EVER, EVER, EVER, EVER, advocate making a card like this and lying to a tyrant.

Outside of minecraft, communists are threatening to arrest people who would make such a card outside of minecraft.
