BREAKING: KAGAN Writes 9-0 Supreme Court Opinion Rejecting Liz Warren's Subversion of Immigration Law
PJ Media ^ | June 7, 2021 | Tyler O'Neil

On Monday, the Supreme Court unanimously rejected an illegal immigrant’s attempt to twist immigration law and create a loophole that would allow thousands of illegal immigrants to become lawful permanent residents. Democratic senators and attorneys general advocated for this loophole, but a liberal justice wrote the opinion for a unanimous Court.

“Petitioner Jose Santos Sanchez entered this country unlawfully from El Salvador. Years later, because of unsafe living conditions in that country, the Government granted him Temporary Protected Status (TPS), entitling him to stay and work in the United States for as long as those conditions persist. Sanchez now wishes to become a lawful permanent resident (LPR) of the United States. The question here is whether the conferral of TPS enables him to obtain LPR status despite his unlawful entry. We hold that it does not,” Associate Justice Elena Kagan, an Obama appointee, wrote in the opinion.

In Sanchez v. Mayorkas, Kagan noted that U.S. immigration law, “applied according to its plain terms, prevents Sanchez from becoming an LPR. There is no dispute that Sanchez ‘entered the United States in the late 1990s unlawfully, without inspection.'”

Yet Democrats and immigration activists twist the law to argue that if an illegal immigrant obtains temporary protected status due to violence or bad conditions in his or her home country, he or she can be considered “admitted” for the purposes of obtaining LPR status...

I'm not surprised, to be honest I was waiting for this to happen. The Left is probably going to wind down the illegal immigration because it's too much of a bad look. They already have enough people in in country to keep wages low and have hollowed out much of the middle class, so they can put a stop to it and get the credit for it.

The pivot will be for legal immigration reform, which will be limitless H1Bs. Now their focus is having the white collar professional and managerial careers held by immigrants, mostly Indians, Chinese, or other Asians who can do the work. The GOP will be incapable of mounting any opposition, because this is essentially what their platform already is.

<< The wise Latina acquired some wisdom for once? >>

Kagan’s a Jewess. Sotomayor is the Latina.

Interesting how many 9-0 decisions we’ve been seeing lately. Appears to me as if the SCOTUS libs are sending a message to Biden’s handlers that they don’t want the Court packed.

Holy crap. Logic has been applied in a Supreme Court ruling. Or the “you can’t make a silk purse out of a buffalo’s butt” ruling.

Perhaps some previous leverage has been removed — blackmail, threats, etc. — something is different.

Maybe they know Trump is coming back soon.

"The idea that the US must allow immigration from anyone claiming “bad conditions” in their home country is simply insane and unsustainable.."

I had this discussion with my 20 year old daughter about six months ago when I was complaining about immigration and wages and she interjected "Well, someone has to help them." I replied with "There are 320 million Americans and 6.7 billion people outside the United States, most of which are much poorer than Americans. How many should we take in? How many can we take in and still be America? Is it 100 million or 200 million? Should we stop government funding for education to feed and clothe them? What if we admit 1 billion foreigners? If we did do you think your vote would still count?. Do you think English even be the primary language any more?" She looked at me in confusion and her young mind had no answer.

I know. I was referring to Sotomayor voting with the conservatives in the court.

Don’t feel too bad, as I had to look up the actual number myself.

Another unanimous decision (written by Kagan, no less) on a case that many would have predicted to likely split among party/ideological lines. It sure feels like the Court is sending a not-too-subtle message. The message: Here's a bone for Conservatives and Americans, so get ready for some real meat to be thrown the commies' way on a much more important case!
