Texas Senate approves 'constitutional carry'

AUSTIN, Texas — Texas would allow people to carry a handgun without a license, and the background check and training that go with it, under a measure approved by the state Senate on Wednesday.

Texas already has some of the loosest gun laws in the country and has more than 1.6 million handgun license holders. Lawmakers have reduced classroom and shooting range training requirements over the last decade, but had been reluctant to eliminate the license requirement altogether.

Some of the worst are the ones you’d least expect - many of the really bad ones are rural towns where the LEO are on a power trip.

Someone in TSRA once told me that there was a pretty good correlation between towns that were speed traps and towns that were bad for 2A or self defense. Never got a look at the numbers, but from a few incidents I’ve heard of he may have had the right of it.

Dang. It’s from FB, so I guess you have to have an account to see it or something. So, here goes:

1) Create an offense for carrying a handgun while intoxicated
2) Remove the $40 fee to receive a license to carry
3) Enhance penalties for peope convicted of felonies who are caught carrying handguns
4) Strike a provision that forbade law enforcement officers from profiling a person based on whether or not they’re carrying a handgun
5)Remove a provision that had said that gun-free zone lawa don’t apply unless a person is asked to leave
6) Require the Texas Department of Public Safety to create a free, online gun safety course. [except that seems pretty stupid unless it’s in person, to tell the truth]

if it’s something else, then I haven’t seen that list.

Even more jealous now.
You should go by the name Sharpshooter.

I used to get out to Odessa quite often when I was driving long haul. There is a warehouse for a retail chain I can’t remember the name of. Used to pick up clothes in New Jersey or crackers/cookies at Nabisco in Richmond, Va for delivery there.

Yeah. 4 and 5 are going to be problems. I’m not white (nor am I black) and I’ve been repeatedly profiled by law enforcement while literally doing nothing wrong. It’s not fun; while I’m okay with including this as a temporary measure to get Constitutional Carry implemented, that needs to go the hell away first thing next session. However, enabling profiling could be enough to lose significant support in the House - not just among the Dems that voted for it but among non-white Republicans. Also has a huge potential to backfire on Republicans and conservatives in Texas.

5 depends on what they mean by gun-free zones and exactly how they define it.

3 would have been better served by making it mandatory for DAs to prosecute felons caught carrying handguns. Enhanced sentences makes no difference if the DA isn’t prosecuting - felon in possession is probably the most commonly dropped felony charge in existence.

6 isn’t a bad idea, actually. Why wouldn’t you want there to be an online option to teach gun safety? Remember, it’s only *safety*, not marksmanship. The NRA Eddie Eagle program to make children aware of gun safety is something that doesn’t have to be taught in person either.

Hopefully the online class would also include information on all the laws pertaining to carry and use for defense. Might be some folks who carry into areas that are banned without knowing they are breaking the law. I see big mess with gun free zones and those that didn’t learn the rules.

Looks like it will die in conference committee as the legislative period ends in a couple of weeks. I am angry that the Republicans allowed these poison pills to be added.

I suspect you are right. Killing it this way allows the senatecritters to get away with looking like they voted 'for' it, when the opposite was actually true.

It’s either Dollar General or Family Dollar. I always get them mixed up. It’s still up and running as far as I know.

You know, Sharpshooter would be a good name. I’m not sure if JimRob would change it again for me and let me retain all my stats. LOL! He was kind enough to do it once. I was LUV W. You can see why I needed an upgrade.

Have you talked to your local rep about this provision. I don’t believe in profiling except in the case of them knowing the person has a record that might accelerate in the future.

I was never able to relate till now, sadly. Plus I’ve lead a sheltered life here in Texas. There is so much anti-white sentiment now, I feel that I’m constantly racially profiled on social media.

I agree with you on provision 3.

I just feel that gun safety needs a hands-on approach such as we had in our high school rifle club. But it’s a good start.

I find almost all of that objectionable, except the one removing the $40 fee, and the online safety course

I guess that’s our Texas independent spirit talking. :) We’ll see how it plays out, but it had better become law. I’d hate for other states to be smarter than we are about this.

Texas does not require a "handgun license". And what the hell is a "loose gun law"?

AUSTIN, Texas — After hours of debate on Wednesday, the Texas Senate voted 18-13 to pass House Bill 1927 (HB 1927). The bill would allow Texans 21 and older who are eligible to purchase a handgun to carry a handgun openly or concealed without a license.

With less than one month left in the session, time is of the essence, so since there was not enough support to suspend the Senate's rules and take a final vote on the bill on one day, the Senate adjourned for about one minute then started a new legislative day to move the legislation forward.

The bill will now go back to the House, where lawmakers can accept the Senate's amendments or request a conference committee, where appointees will resolve the differences in the chamber's versions.

Gov. Greg Abbott has previously stated that he would sign the bill into law.

Lt. Gov. Dan Patrick released the following statement following the bill's passage:

“I am proud that the Texas Senate passed House Bill 1927 today, the Constitutional Carry bill, which affirms every Texan's right to self-defense and our state’s strong support for our Second Amendment right to bear arms. In the Lone Star State, the Constitution is our permit to carry. I congratulate Sen. Charles Schwertner for his leadership on this important issue and for the thoughtful and respectful debate in the Texas Senate today. We have moved quickly on this legislation and I want to thank all those involved who helped gather the votes needed to pass this historic bill.”

Thank you Conservative Texas Representatives, Senators, Lt. Dan (as I like to call Lt. Governor Dan Patrick in honor of Gary Sinese in Forrest Gump) and Greg Abbott. It's been a long fight, glad to see the fruits.

The fun part - I have actually been profiled for being a motorcyclist far more than my race. Which you can’t really tell until I take my helmet off.

The not so fun part - back when Boomers were more a part of police forces than they are now, apparently the majority of officers I encountered seemed to think (like, well, many other Boomers) that all motorcyclists were scumbags straight out of Easy Rider or the other anti-motorcyclist 70s movies. No matter how attired or what they were riding.

Well, I guess the Hell’s Angels “types” have turned out to be some of the most patriotic folks we know. Maybe they were all along, but I admit, I was afraid of some of those big ol’ dudes when I was younger.

My hubby rode a motorcycle but it was a Honda or a Yamaha. Not as much stigma to those. I even rode behind. I could never get the hang of changing gears with your feet. LOL!

Yup. Having a gun in your hands without being licensed and background checked is a surefire way to turn you into a homicidal maniac. You just can’t help yourself. You’re gonna go shoot up a mall or a schoolyard as surely as the Lone Ranger wears a mask. Even smoking a newly-legalized joint won’t calm you down. It’s a known fact./s
